    If you are not a criminal, then you should have nothing to fear.
    That is the problem with the Megrahi case. Regardless of whether Megrahi did it or not, the evidence was so flimsy, that the innocent do have grounds to fear wrongful prosecution and conviction

    If we have a harsher punishment system then it goes a long way to deterring the crime in the first place.

    I once had to go to court on a speeding fine.
    I was doing pretty well for myself and got 3 points and a £250 fine.
    It was on a dual carriageway leaving a town and I was caught doing 55 on a 40 stretch.
    The thing is, on the same day, I saw people that had been banged up over the weekend on drug crime, knife crime, fighting and causing bodily harm who all received lesser punishments.
    So how many points would you give for drug crime, knife crime, fighting and causing bodily harm?

    The point is punishment does not deter, because by and large those who are punished are beyond caring.

    And if the law demanded you do something completely unethical?

    Give me an example of an unethical UK law?

    If were taking a broader context, I'd possibly campaign against the law and if all else fails and the law remains unchanged, I'd consider moving to a place where the laws are not so unethical.

    1) If they are beyond caring, should they be either released back into the community where they can continue to do their uncaring actions

    or

    2) should they receive a harsher punishment which would possibly relieve the community for a time being and act as an example to others which may become a deterrent to others.

    I guess some of the soft people on here would choose 1 but possibly throw in a holiday for them to get them away from the community for a short period :rolleyes:

    Under 2, you really need to make a strong distinction between preventive detention and punishment. A year of one is not necessarily the same as a year of the other.

    I believe we have already reached the point that the punishments are generally harsh enough to deter anyone who could be deterred by a harsh punishment.

    At some level, the solution is along the lines of bringing people to the point where they want to respect the rest of society. That is not to say that I know what the solution is - in the same way that anyone who does not know how to bring a dead horse back to life can still say quite accurately that flogging it has not worked and flogging it harder is no more likely to be successful.

    It's a philosophical question. Not about current laws. ID cards, had they been brought in, might have been something I felt strongly enough about, though.

    What about terrorist laws being used against Iceland? and what about the detention laws that Blair wanted to bring in not to mention internment in Ireland.
