You are right of course.
The gym cannot just wash their hands of everything by simply displaying a disclaimer. However, were this to go court, I think a judge might find a rather large grey area between the black and white as leaving £800 worth of stuff in an unguarded gym locker might not be considered prudent, especially if there was a sign saying "Do not leave any valuables in the lockers".
Now if nothing of the sort was displayed, and given that this looks rather like an inside job (we probably all agree with maninthestreet here), it might just be worth getting some legal advice before losing the no-claims bonus on your insurance.0 -
Thanks everyone, I've tried to claim on my household insurance with Endsleigh, but am not liable as it only covers contents within my property, I am going to upgrade this following this experience. There were a few similar incidents a few months ago, and many incidents in the car park with break-ins. I haven't been to the gym since because I simply cannot afford to lose another £800 (iPhone (worth £500)+ expensive spectacles(worth £260), as well as £50 cash, £25 Oyster card, £33.80 rail season ticket, £20 for a new driving license, swimming goggles, swimming shorts, towel, library book worth £60) were the possessions that were in the locker, I have to put my belongings somewhere and you want to be able to trust the lockers. They do have a disclaimer when you enter the locker room, however where do you put your wallet / phone / glasses (which I need to use for driving), I can't take them swimming with me! I have tried to contact the manager, however the phone calls have not been returned and emails have not been replied to.0

I may have misunderstood but didnt you just say you were swimming right after saying your swimming shorts/goggles/towel were in your locker?
Did you keep them there overnight or do you regularly swim naked?

Nah - I was in the gym this time - went back to my locker after my workout and was about to go swimming when I discovered everything missing! Obviously I didn't go swimming after that!0

Completly off topic.
I was a member of Esport in Stoke for years and they had the same problems their. People would come back to a locked locker to find wallets, phones, cash missing.
Esporta blamed everybody but Esporta but how else do you get into the locker unless you have a master card that opens all.
Was one of the reasons i moved to another gym.0 -
The police are just guessing, as there is no evidence to further the investigation. They have now closed the case. The thiefs used my credit card and spent £7.60 at the local Weatherspoons in Croydon town centre afterwards at 8.28pm (strange as there was £50 cash in my wallet) . I was hoping that they could check gym CCTV and pub CCTV and try and match the two up but the police said it's unlikely to work so they didn't do it.0

Would using your credit card not require the pin though?

Someone told me that Weatherspoon's pubs still use the traditional swipe method of payments which makes sense so they wouldn't need my pin, just need to fake my signature.
It's kind of strange that Esporta don't let you use your own locks like most of the other gyms, it would make things alot easier.0
