Gym Locker Broken Into - Esporta Croydon

I had all of my belongings stolen from locker number 10 in the male changing rooms in Esporta Croydon on Wednesday 30th June at 8.30pm, and the locker was completely locked when I came back from my workout leading Sutton Police to suggest that it is most likely someone with a master key who did it, such as gym staff. I lost about £800 worth of stuff including an iPhone, expensive designer glasses. I signed up to a 12 month contract in April, so still have 9 months remaining. It says in the contract that I can only cancel if I move out of the area, are made redundant or have a GP note. However, I feel the gym is not secure, I have to put my belongings somewhere, and despite the high membership fees, they do not have CCTV inside or outside the changing rooms (although CCTV is all over the rest of the gym). Do I have any rights to cancel my gym membership, as the amount lost is more than my yearly gym membership fees, and I've simply lost so much, I don't want to pay for the gym anymore, especially as they are not putting anything into place to stop it.

    Check your contents insurance, you may be covered, especially as you have a Police Report.
    Personally I would not let this rest, have you contacted the manager and the Head Office?
  • I trust they have a disclaimer prominently displayed? Otherwise it might be worth getting a professional to look into their possible liability.

    Just tell them you are moving out of the area (work related) if you just want to cancel your membership.

    They are not allowed to use CCTV inside the changing rooms for obvious reasons.

    Best course of action will be through your home contents insurance.

    Not difficult to be carrying £800 worth of stuff. In my handbag (£60) I keep my purse (£30) with approx £20 inside.

    I have my iPod (£150) my lowly Nokia (£100 ish) my work BlackBerry (£300) amd my camera (£150)

    If I were to undress for the gym, I'd be removing my glasses (cheap varifocals from Hong Kong and a bargain at £120) my watch (£60) and my engagement ring (£priceless but about £1000 to replace).

    That's before I add my shoes and coat...

    While I do agree that most people would struggle to leave £800 quid's worth of stuff in a gym locker, whether the amount is £800 or £80 doesn't really make any difference to what has happened.

    Liability is usually defined in law and in most cases, having a disclaimer wouldnt actually absolve you of any liability if you are responsible by law. Otherwise (as has been said several times in other threads) everywhere would have disclaimers and we would have no recourse if something went wrong.

    In other words, if something like this happens and they use a disclaimer to try absolve themselves of liability, check that they arent liable and dont just assume - they dont necessarily have your best interests in mind :D
