What questions, im not avoiding anything or anyone?
So what's your point? Is it that ash is lying? That's how it reads to me, I hope I'm wrong but that's the implication as I see it.

No wonder some MSE`s think that this board is for people to cheat DLA
I know that's what you think because you accused me of just that in another thread. I still didn't get an apology from you when I explained myself - which I didn't have to do. So anyway, are you accusing Ash of lying or what?

These are the questions I asked. Basically I just wanted to know if you were accusing Ash of lying.

whenwillitend - thats great that the GL24 has been sent off - that bit is now out of your control.

I understand what you are saying with the additional evidence - i would start a diary of her actions, moods and condition from now - and start building up a record of how her condition impacts her - also if she has violent outbursts, video it , i have heard that this has been accepted in appeals because it gives the tribunal panel a better idea of how she is. Sometimes images are more powerful than words.

Take photos of any injuries she causes or inflicts to herself and others if applicable - it may all seem OTT but they wont know unless you spell it out to them clearly. They will not be experts on mental health necessarily.

Anything, however trivial it may appear, needs to be noted down - remember that you are used to dealing with her and may take some of her disabilities as 'normal' but they may not be - you will soon find that it will mount up and hopefully provide support for your appeal.

Once you have done this for a few weeks months you can clarify accurate data to the tribunal.

Go get a folder / large pad or something from staples and start tomorrow - every bit of evidence will help.

    Best of Luck x

If you asked for a reconsideration (as it sounds like you did) you only have 6 weeks from the original decision date to lodge an appeal - if you are still in the timeframe get a GL24 off to them asap.

You need to ask for the statement of reasons to have 6 weeks ty lodge an appeal - otherwis it's 4 weeks.

I personally wouldn't get them to do a reconideration - just go straight to appeal.

I asked for a reconsideration after receiving my statement of reasons as it completely contridicted everything i'd wrote on the application form.

You are not at risk of suicide/selfharm? despite there being at least 3 recorded suicide attempts & at least 2 recorded self harm incidents.

They soon changed they're minds after i'd pointed out they're mistake & sent additional proof in the shape of a pyschiatrist report.

I was consequently upgraded to middle rate care without having to go to appeal which is alot easier, quicker & much less stressful.

If you go for appeal, they do reconsider before it goes to appeal.

They keep doing this to me. I put on my form that I have depression and have had episodes of self harm - they claim I'm not at risk of self harm. I'm worried they're going to say the same thing this time around.

Shouldn't be surprised really - they've also told me I should have no problems reading.

  • i have allready done a phone appeal that took 10 weeks an all that changed was she was at risk of self harm but nothing else that was with a report from her chams worker an re-peated up dates as she had her sessions with the psyciatrist, i did the gl4 an why i dissagreed one of the points in them saying she did not need supervision as she was not a risk to her self was very contradictory, they admit she self harms but say she does not need to be kept an eye on like its ok for her to have these tendencies

any way i guess its all a waiting game now

I think they hope that people will get fed up waiting & lose the will to fight.

Just don't give up & if possible attend the tribunal with your daughter so they can see for themselves how ill she is.

I had my mum, my ocupational therapist & a lady from the National Autistic Society attend my tribunal with me & I still got really upset & burst into tears.

It is a stressful situation but that might be what it takes for them to realise how much support she actually needs.

I agree with you and I do know what true depression is having had to be treated for it following PTSD.

However I would honestly expect anyone suffering clinical depression to be treated , as i was, with anti-depressants, counselling etc. I would seriously question anyone who claims to have clinical depression but opts not to have any treatment. And who is able to post fairly coherently on here for hours on end.

I have been treated for clinical depression and PTSD (now adjustment disorder) and if more people have real treatment instead of just idleing there wouldnt be as many people who now see no cure and a lifetime of disability benefits and not being able to work.

People need to seek treatment and diffrent people need difrent treatments, I needed to trust my clinician wholeheartedly and it took a while but it worked for me and drugs didnt seem to help me(Im not neuro typical).
