    Hi all

    Elijah's bedtime is later than most of your school-age kids :/ but at least he is settling faster recently.

    He is possibly developing an understanding of how to tease people... I've mentioned before how freaked out OH is by spiders - this morning she came into the kitchen in her dressing gown, he said "HI Mama!" then looked at her, then said "Mama, spider!". She panicked and flailed at her dressing gown and spun around, then a few seconds later he said "Spider gone." and gave her a biiiig smile :p

    E and I have been to the farmer's market and the park so far today, then I came home and cooked us all bacon avocado cheese tomato sandwiches :) now I think I might build his toddler bed which is currently still in a box, and then we're going to a friend's barbecue for early evening which should wear him out for bedtime I hope!

    I hope someone official steps in to help you, 3. Small claims vs R is definitely possible but maybe a watchdog/trading standards intervention first might expedite :/

    I believe it was SS who invited us to look at thegadgetshop? I've just ordered a few cheap bits for relatives who you buy for as a token gesture and the twins have Moo Cubes on the way :rotfl:

    Funnily enough - i've had an info pack through the post from Trading Standards, with all the info for small claims.

    The trading standards man had been trying to phone R yesterday afternoon, and eventually sent her an email. He's going to call me if/when he gets a response.

    Oh, that's great! He should have a clear understanding of whether we are all right that R is 100% your target as far as the refund is concerned, and if he says it, maybe she'll roll over.

    That isn't to dismiss the issue of abusing G and her camps for their unprofessional conduct and etc of course...

    Do, if feasible, go down the small claims route. I've done it six times for various things and all have paid up/refunded within days. They don't like it up 'em.

    Naturally, this should be an avenue to be explored once all other areas have been investigated and it sounds as if trading standards are still involved, so this is a step for the future that I hope you need not go down.

    From speaking to him, he seems pretty certain that I paid R so my claim ends with her.

    Who she claims the money off isn't my concern - which is pretty much the gist of last nights conversations with R.

    He seemed to be saying he'll see where he gets with her, if nowhere, he's sent me the info to start the small claims.

    It's really simple. It's all about the wording, keeping to the facts and making it as simple to understand for any court officer as possible.

    Trading Standards would be correct in regards to claiming your money from the person you paid and/or the company they represent. As it was a personal account (to R) that I believe you paid? the buck stops with R. The company may not be held liable if the person you paid had no mention of the company in any correspondance, although if in any paperwork you have it suggests that 'R' was taking payment on behalf of the company, then they would have to answer as to whether that was the case, but generally, the buck will stop with whoever received your money. It would be like you paying me to go to B&Q to buy some paint and me getting you sub standard quality paint. You couldn't blame B&Q, but you could argue that I gave you sub standard goods and you'd be asking me for the cash back.

    I hope it gets sorted very soon, but they sound very unprofessional and i'm glad people have screenshots of the conversations as any lawyer worth his salt would be able to pick things out of it, judging by how those on this thread have relayed what the tone of their response was (i've not seen it myself).

    Hope the TS guy does his thing well, 3. I can't believe after having the law quoted at her last night she kept on saying she wasn't responsible. Talk about unprofessional and stupid... and was her phrasing "you won't be getting a refund out of me" or "from me"?! As though you're trying to scam her :rotfl:
