I always remember many years ago I had a citreon 2cv with the canvas roof when the local yobs decided it would be fun to jump of the flats balcony onto the roof. Unfourtunatly for him he didnt realise that in the middle of that soft canvas roof was a steel support bar....Several broken ribs and severe bruising followed...he didn't do it again!0

How on earth could that not have resulted in injury even without the steel bar anyway? Its a roof not a trampoline!

What i want to know is if someone jumps onto your bonnet and leaves a dent what will you do?
If you do a citizen arrest and hold the idiot till the police arrives can you get him to pay for the damages?
or do you have to repair it yourself?
don't know why but i feel the police will just give him a slap on the back of his hand and left him go in the morning
I would be wary of intervening for a citizens arrest and it would depend on the situation from a safety perspective aswell as being able to justify any force used or have witnesses to support any action. In the case you describe I would first consider phoning the police on a mobile and telling them the persons location from a safe distance. You can only arrest if the value of damage is above £5000. In addition, you should ideally only arrest if the person tries to escape and would otherwise not be apprehended in time by a constable.
You cant force him to pay for damages - doing so in a threatening way would also cause you considerable problems even if you prove that he commited the damage. It is something for the courts to decide whether you receive compensation.
You could make a civil claim against the person for damages. (even if they are found not guilty - although it is easier if they are).
If the car is parked on a public road - it is a specific offence to stand on top of it. This is known as tampering with a vehicle. (Road Traffic Act 1988 s.25(a)
So you are justified in calling the police for this act alone.0 -

As far as I could interpret from all the legal mumbo jumbo, this only covers things where it may create a danger to road users, such as cutting brake pipes. Standing on top of a car does not create such an imminent danger as cutting a brake pipe.
Let me try to help a bit then.
25 Tampering with motor vehicles
If, while a motor vehicle is on a road or on a parking place provided by a local authority, a person—
(a) gets on to the vehicle, or
(b) tampers with the brake or other part of its mechanism,
without lawful authority or reasonable cause he is guilty of an offence.
It is not a difficult offence to interpret.
Simply, if you stand on a car - parked in a public place, without reasonable cause you are guilty of the offence.
I have bolded the "or" part because it indicates that you dont need to tamper with any brake to be guilty.
the part about tampering with brakes is section b which is dealt with seperatly. Hope that helps.0 -
