I would tread very carefully with this, looking at the buyers feedback (over 1000 and 100%) they buy lots an lots of mobiles all the time so in theory must be selling them on via shop or maybe just a market stall or something, this would explain the close working relationship with a Nokia tech guy for one and also the terminology used in their emails, with over 1000 feedback and being a member since 2002 they have proved to Ebay they are reputable so have you, you have excellent feedback etc however this matter has now arisen and Ebay frown big time on fakes because they get so much hassle from manufacturers over them.
If I were you ( I have traded on and off on Ebay for many many years now, have more experience with both Ebay and Paypal than I care to discuss lol) I would be contacting Ebay and explaining the situation to them, if you have no contact with them and this buyer gets a refund through paypal expect your ebay account to be blocked, it is common practice with fakes you need to be speaking to them and explaining you knew nothing about this and you are willing to do whatever necessary to resolve the situation upon proof of the phone being deemed fake by Nokia.
Wait until she emails you this proof then take any necessary steps to contact the nokia tech and confirm his findings yourself, if this happens for the sake of your own ebay and paypal account dont mess around refund her immediately and unfortunately the only thing you can do is chalk it upto experience.
NEVER EVER EVER EVER EVER EVER EVER EVER EVER EVER UNDER ANY CIRCUMSTANCES buy branded electronics from the far east and I mean EVER! There are some excellent electronics coming out of China and the likes but definately nothing branded, if it is an honest item with a name you have never heard of and the seller has good feedback chances are it will be a good cheap alternative to an Ipod etc etc, if it is branded apple, nokia or anything else there is an excellent chance as in probably around 95% that it will be fake.
Most of all keep your communication with this buyer friendly, she understands you are a victim as well from her emails so keep thing pleasant she will be less likely to lodge another complaint with Ebay then.
You are in a terrible situation and unfortunately at the mercy of the money making machines Ebay and Paypal that never listen to common sense and have "procedures" for everything wether they fit the problem or not.
Best of luck in getting it sirted, do communicate with Ebay though, you may end up having your account blocked either way the one thing I can almost guarantee is they will block it if you dont get in touch and fight your corner."You can measure a man's character by the choices he makes under pressure"Sir Winston Churchill0 -
Just thought i will pop in quickly to let you no this n85 is not fake it 100% real and inst a copy as most fake n85 at the top right hand said have n00 or the word Nokia is wrong this person you sold it has no idea what they talking about and Nokia the home place of Thailand
If you have any pictures of the back and inside the battery bay that will help loads more?
Did you watermark the phone before it was sent out? soo if you do get it back you have been sent the right phone?
Anyway best of luck0 -

No paypal will not care about extra photos. All they want is a letter on headed paper saying it is a fake, if buyer supplies that then the OP is in trouble.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. I really can't see how you can be so sure without actually seeing the phone. How do you know there are no fakes with n85 in the top right. You use the term most which means there must be some that are. Being so definite from some pictures is a bit of a leap
Its academic anyway all paypal care about is the original listing and anything on headed paper from Nokia. Any extra pictures will be ignored0 -
i called ebay and explained everything. They registered my call and told me ''there is a scam going on! they swap genuine items with fake ones and send them back to sellers''!.
i will give a call to Nokia after i got Nokia Tec.report.
thanks for your help.0 -
Hi OP I see on your listing you have a checkmend report on that report is Nokia listed as the manufacturer.
If it has come back as a Nokia phone on your checkmend report in the Manufacturer information section then it is not a fake as this is one of the things checked on the report using the IMEI number and checking which manufacturer registered that phones IMEI number so your checkmend report will be 100% acurate as all IMEI numbers are unique to each phone any problems with the IMEI number would have shown up on your checkmend report.
This is why ebay and the police advise thet it is a good idea to get a checkmend report done on any mobile phone before you sell it see the link http://pages.ebay.co.uk/buy/guides/mobile-phone-advice/
As for advise it may be worth your while emailing your buyer and pointing out that you already have a report from checkmend that they can verify online free of charge that proves that your phone is genuine and that ebay and the police both back checkmend as the best way to verify if a phone is a fake or not.0 -
thanks for your advise. Do you think i should wait for buyer's response or just email her ! explain everything0

What are ebay doing, if they know that the site's being used to scam people? Are they actually on your side in this? As they said that they know there's a scam going on I would ask them how they want you to proceed.0

I'm afraid that I think this is yet another case of ebay telling a seller want they want to hear just to get them off the phone. This is not an unknown scenario and sometimes the stuff they say is just incredible.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards.
