So im not sure on where i stand with it all?
Thanks for the replies
What date did you leave their employment and what date did you ask for the contract to be cut off (or what date was it cut off/did you stop using the contract)?
It doesn't sound like you have acknowledged the debt recently by just asking for login details.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
About this time last year, my son took out a number of payday type loans with several different companies, including Wonga. He finally reached the position where he had no money left, as all his wage was being taken in repayments.
He returned home, where I took control of his finances, and made arrangements to pay off all his creditors.
We fully believed that we had cleared all of his payday loans until today.
He has just received a letter from MacKenzie Hall, giving a loan number & amount due as Wonga have now - "legally assigned your debt to MacKenzie Hall Debt Purchase Limited as of 6th July 2012.
In order to avoid further action payment can be made by post, etc, etc".
My son cannot remember how many loans he took out, or what repayments he made. If he did borrow the money,& it seems likely that he did, then he must repay it. Should he just send them a cheque to settle this once & for all? Or does this open us up to even more demands?
Why haven't we been contacted by Wonga if this amount was outstanding for so long? Is this usual?
I suppose what I am asking is that I know MacK sound like a set of sharks, but if it is a genuine debt, will paying this be the end of a problem that has been ongoing for a year?
Please understand that this is in no way an attempt to avoid paying a genuine debt.0 -
Given MH's reputation, I think it's wise to be cautious. This might or might not be your son's debt and it might or might not have reached the balance they claim under a contract he agreed to.
So send a prove-it
I might change one line to 'We would ask that no further contact be made concerning the above account unless you can provide evidence as to our liability for the debt in question and the balance you quote'
Bear in mind that if MH have bought this debt then they didn't pay much for it. So, if it turns out to be valid, you might want to try a full & final settlement at maybe 30p in the £.0 -
Thank you for replying & for the "prove it letter". I wasn't sure how to word this, so it is a big help.
Will send letter today to both Wonga & MacKenzie Hall - is there any point in trying to talk to them on the phone, or is that pointless?
Also, we have had NO communication with Wonga over this loan at all - shouldn't they have tried to collect any debt before passing it on? I don't understand why this has just turned up out of the blue.
If Wonga and/or MacH are unco-operative, who exactly IS the regulatory body?
Who do I send a letter of concern/ complaint to? is it the Financial Ombudsman Service, or the Office Of Fair Trading?0 -

OK, no need to write to Wonga. MH have said the debt is theirs so it is up to them to prove it. If evidence is required from Wonga (and it will be ) then it is MH's job to get that, not yours.
It is not for us to speculate why Wonga have not been in touch. There could be many reasons.
Absolutely do not phone them. More than that, if they phone you, you should request all communication in writing and put the phone down. There's a standard letter for that if we get problems.
At this point you don't need to complain to anyone. For information the regulatory body is the OFT and their file on MH probably has it's own room! Their trade body is the CSA (Credit Services Association not the other one) and all debt collectors are monitored by the FOS, who can award compensation in some cases.0 -
Got a call from these tonight. Wouldn't have answered normally but it was a local code. Surprised by the Glaswegian the other end....:D
Can I have your name and date of birth sir?
Eer - No
Why not?
Eer - I don't know who you are.
It's a personal business matter...
I Have several, which one are you?
Would you like me to send you a letter?
Yes
Goodbye.
Sneaky tactics - either using locally based agents according to dialling codes or more sinisterly hijacking vacant numbers?
Anyway, no sweat - will await that really (not) official looking letter.0 -
Think they are based in Kilmarnock. Are you near there?0

It's not software, it's a legitimate product sold by many operators.
Any business can take a local number and have it routed to another number elsewhere in the country. It's useful for small businesses who cover multiple areas to show a local presence.
Obviously Mucky Hall are using it to make it look as though they are calling locally.0 -
I have lived and worked overseas for over 7 years now. Early this morning (before 8am) MH called and asked for me. I haven't actually resided with my parents since 1989, though I use their address for UK based correspondence (I have a NatWest account). The person who called said they were "Mackenzie DC" and would provide no more information. My mother said I don't reside there and haven't for many years. They just gave the following phone number and hung up: 01563 554540.
Through google I've concluded them to be the afore mention agency and so I sent the following email to this address:
pmackenzie@mackenziehall.co.uk

Dear Paul
Re: telephone contact - ***** ******
The above phone number is that of my parents’ home. Members of your company have contacted this number, before 8am, to wake my elderly parents to ask to speak to me. I have not resided at this address since September 1989. I live and work overseas. I have occasionally used this address for UK correspondence.
After investigation, I have found that your company is a debt collection agency. I have no debt.
Please provide proof of this debt, via email, in the form of signed agreements or any last payments made.
This email address shall be the only point of correspondence. Should all contact from your company not cease and desist immediately for the above telephone number and associated postal address, I will seek to take action against you for harassment under section 40 (1) of The Administration of Justice Act 1970. I am also considering the possibility of action under the Human Rights Act 1988 as it is my opinion that the actions of Mackenzie Hall are in contravention of the Right to Respect for Private and Family life enshrined in the Act.
From my investigations, it has also come to my attention that this is in direct contravention of the requirements imposed on Mackenzie Hall Ltd by the Office of Fair Trading on the 15th April 2009.
Yours faithfully,

Will this suffice? Is there a better email address? How can I ensure my parents aren't harassed further? Please advise0
