Tesco misprice policy discussion area part 8

I got an x-box 360 - the expensive one (£279.99) with the extra bits. Offer of £20 with game of the week (Prey) didn't come off. C/s offered £20 off, then the free game, then after consulting the manager a full refund of £319.99. No quibbles at all.
The offer was advertised on a poster dated w/c 1/9. This said that Prey was the game of the week. I suspected the discount might not work as Prey didn't have a yellow SEL. Don't know if this is right though.0 -

i was genuinely shopping tonight for our HUGE party we are having tommorrow, and purchased lots and lots of goodies.
Upon checking my receipt, before leaving the store, I noticed that a bottle of Sminoff had been double scanned. I went to Cs desk, lovely cs lady apologised and refunded the £13.xx. and I left. When I got to my car I thought " ehm...should that have been a double refund and got to keep the bottle of vodka?" surely not?? I showed my receipt to my DH and he said that they were wrong and had overcharged us in effect £26.xx for a bottle of vodka so we should get double R&R.... I went off back to see nice CS lady who explained that I hadnt been more than the SEL and that double scans dont count for R&R. It actually did look quite clear on their policy notice too?? so now I dont know if I should of had a double R&R or not???
what do you think guys??? did that nice CS lady just pull the wool right over my eyes??
p.s I will still enjoy the vodka but oh how much sweeter it would of been if it had been R&R'dpinkpinkfizz

" After 20+ years of working in law..." In other words, he didn't claim to be a lawyer. He claimed to be working "in" Law. That could mean just about anything, from a Barrister's clerk to a clerk in a local Magistrates. I don't think he's a lawyer (lawyers know how to spell, for starters...).
Criminal law would not apply in this case (other than Tesco repeatedly charging more than the lowest advertised price). This would come under Contract Law. There is no dishonest appropriation. The customer legally buys the goods under the law of contract (offer, acceptance, etc, is all done at the checkout). So, when the customer approaches the CS, the customer already owns the goods. The customer cannot force Tesco to stand by the Promise displayed in every store in the country. It's entirely down to Tesco. Nowhere in the promise does it state any terms and conditions, such as "if you knew you were going to be overcharged, this does not apply to you". It's a blanket promise to all customers who buy things from Tesco, regardless of whether the customer thought the price might well be wrong. Yes, it's morally dubious. However, it is not illegal.In a rut? Can't get out? Don't know why?

definately an r&r. Sel £13.xx - scanned £23.xx, to me that is an incorrect charge.

I went and told them they had made a mistake, and I explained it to them. One of them went off to have a look. At the time my partner was in the games aisle to make sure they didn't take down the £10 off label and claim it never existed. According to my partner the tesco employee spent around 5mins looking at the label, flicking through looking at some behind it and finally taking it down and having a discussion with 3 or 4 other staff. They then took it to the price checker/scaner point (which doesn't work when a member of the public tries to use it, but worked for them) then continued their discussion for another 20mins or so (with my partner following them). All while I waited patiently at the front. :?
They then came to the front and the employee said that I'd "been overcharged by ten pounds, was this correct" so I said yes and she asked if "I wanted ten pounds back" and I told her that I was "just looking at the price policy doings on the board there", at which point she said she would have to ring someone, which she did. Then a management looking type came over (but he wasn't wearing a suit, pretty much same uniform as the rest of staff) and had a word, she carried on on the phone then she gave me £320 and asked me to put my postcode etc down.
They looked extremely shocked that they were having to refund me, I don't think anyone has ever used their policy (at least not for that amount) at that store before.
I have no doubt that making me wait for nearly an hour was designed to intimidate me, but I was having a laugh and talking to the staff at the cs desk & it seems they were far more intimidated by my partner following them. :>

Incidentally, I spoke to CS during the week and was told that the Xbox 360/PS2/PSP issue was down to a technical problem. HO has known about it since the 26th August. They've had ample time to get it sorted out. They could have withdrawn the items from sale, programmed the till to flash up a warning at the cashier, or make 100% certain the POS has been taken off the shelves. HO did none of these things. Yes, they emailed the stores. However, they know the stores do not necessarily bother to implement orders sent via email. (They know this by the sheer number of complaints they've received over this particular offer). Worse than that, HO sent a communication to Dundee CS advisors telling them to refer all complaints back to the stores. The offer still does not work and the items are still on sale. Tesco is knowingly breaking the law with this one now.In a rut? Can't get out? Don't know why?

You seem to have failed to read the post correctly. The item scanned correctly at £13.xx, but was scanned twice. There was no mention of it scanning at £23.xx.
In my personal opinion, R&R does not apply in this case. I know there are different interpretations, but if you look at the actual wording of the policy on the first post of this thread, I don't think the accidental extra scanning of an item qualifies.

i only happened on this by chance in tesco today, actually buying the xbox and i hadn't even seen these forums, i've never even had a tin of beans r&r before, so when i get blatantly overcharged i would love to get the xbox refunded according to their policy!0
