    Without Prejudice...

    Overt Recording
    If all parties know that a conversation or actions will be recorded, the recording is overt. Anyone opposed to the recording can decline to give their permission and the recording should therefore cease.

    Covert Recording
    Covert recordings are those that are made without the knowledge of the subject of the recordings.

    Covert recordings can be made by bodies ( EG Police, Security Services, Local Authority Directorates ) who are authorised to do so but they are subject to compliance with the Regulation of Investigatory Powers Act 2000 (RIPA).

    Covert recordings that do not comply with RIPA either because they are carried out by an unauthorised body or because the RIPA regulations are breached, maybe unlawful and may breach an individual's human rights.

    It is not illegal for individuals to tape conversations providing the recording is for their own use, under the Regulation of Investigatory Powers Act 2000 (RIPA).

    It is a civil, not criminal, matter if a conversation or e-mail has been recorded and shared unlawfully.

    If a person intends to make the conversation available to a third party, they must first obtain the consent of the person being recorded.

    I agree with your sentiments with regards to Ts overpricing.... this ought to be addressed more stringently.... and in my experience, when visiting CS, they update their computer there & then ( ?? )

    The original points of my email was to advise people they MAY be committing criminal acts ( ... Did the person concerned believe that what he did was dishonest at the time?... this could amount to theft )

    And ... by knowingly & repeatedly claiming a FULL refund whilst retaining the goods....thereby abusing Ts trading policies, some people :doh: ruining things for the rest of us

  • Got a xbox360 from tesco today.

    Premium system with game, should've been £280 + £40 - £10 discount.

    Discount didn't come off so was charged full £320 (prices rounded up to nearest £).

    Took them about 40mins of having discussions between themselves before they offered me a refund.

    Spunk-Bubble-Tesco 0, me 1.

    Need a few more showers now, feel dirty going in a supermarket (even if it is only to make them lose money). :>




    How did you get them to refund you? I bought one with Prey game today and all i was offere was the game for free, manager wouldn't budge , even with me calling head office
  • just thought I would update on my psp/game saga, I have had an email back from customer services as follows.....

    Thank you for your email.

    I was sorry to learn that you have experienced a problem when overcharged at
    one of our stores.Our refund policy is displayed in all our stores and part
    of this states:

    In the event that we overcharge you, we will give you your money back and
    you can keep the product. This does not affect your statutory rights.


    However, I am sorry for the poor service you received when you returned the
    item to our store and I have informed our Store Manager who will ensure the
    matter is addressed with the staff concerned.

    I have emailed back asking them to clarify that I can have a refund for both console & game and got this response...

    I am afraid you will only be refunded for the game.

    I have emailed back again asking why the game and not the console for instance am awaiting a reply!!!!

    I appreciate that you are new(ish) to this thread (possibly) unless you have been lurking but if you follow it for a while you will note that the same misprices occur again and again in the same store. Ecover washing powder was a prime example

    I believe the computer pricing can only be altered centrally, not at individual stores so there is the problem, individual stores report misprices via their reporting to HO but the communication seems to break down somewhere as misprices continue. I do not think this is a conspiracy on Tescos part just bad organisation

    A few posts earlier (201) someone reported buying a games console today and being overcharged despite this coming to HO's notice over the last weekend. It has been estimated there could be an approximately £600,000.00 loss to Tesco on this and they are now quite often refusing to honour their own advertised promise

    Perhaps, taking all this into account, you can understand why a minority of their customers choose to "get even". I myself take advantage of their promise but little and often and usually food. I could have gone and got a games console but would not know what to do with one so resisted the urge

    I do not wish to be an apologist for R&Rs because I understand their motivation

    Twenty years in law eh and still having to money save, you must be in the wrong branch of law (just kidding)
    Only time will tell if I am right or they are wrong

    Perhaps if they actually sorted out the problem when it first arose it wouldn't have such a problem on their hands, its been happening for over and week and people are still managing it today.

    an just to let everyone know we now have a kitten.. a bit sorry for it self... as its a little runty thing... and looks quite ugly really.....but hay its got feelings to....so...as its a odd looking kitten it will fir in quite well in our house hold....even my duck called charlie drake is ugly... he's a muscovey .. with ugly red growths on its head.. ( which is part of the breed)...

    sorry for being off thread... but just answering a question.... and getting a bit carried away....

    but to bring it back into topic.... i am now looking for any cat things on r & r..:D

  • Sorry if I'm a little off topic here but has anybody had sucess with R&R and ambigiously worded SELs?

    I saw the Xbox 360 offer in my local Tesco's today and the SEL reads "Save £20 when you purchase a Xbox 360 or PS2 and the Game of the Week". Now I could see a pile of games next the PS2 boxes stating Game of the Week, but could not find a Game of the Week as such for the Xbox. I proceed by calling a member of staff about the deal and asked where the Game of the Week was for the Xbox. After looking re-reading the offer SEL a few times, he came to the conclusion that there was no Game of the Week for the Xbox, and that £20 would be deducted for buying the Xbox alone. He said that it was only the PS2 with which you needed to buy the Game of the Week to get £20 off. As there are clearly two ways in which the offer could be understood, are there any grounds for claiming an R&R?
  • Whether you claim misprices with Tesco because you are "moneysaving" or "out for a console" you are doing the same thing, both knowingly & repeatedly abusing Tesco's trading policies.

    No matter how you bend you morals to suit your opinion, both are as bad as each other.

    The console hunters are doing what we're all doing (not me just yet haven't plucked up the courage) they tend to get a bit more excited and vocal. If you added up all the Ecover washing that was taken as misprices, its loss may be more than all the successfull console.

    We're not abusing the trading policies as there is no stipulation other than they R & R, and that it's at the manager discretion as to whether you can still shop there. So the most they can do is deny entry or an R & R.
