  • Morning all

Am awaiting post man to see if any more news re interest!

Have a leaky roof, hopefully will be sorted soon and for once I have money in the emergency fund to sort it what I hope will be a fix. Whilst it's a devil to see it go at least it is there, no CC and no weepy phonecall to CCCS and waiting for the preditor chaos after.

Hope you all have a good day.

Hiya Squirrel, without supplying a CCA after 14 days + 2 and now coming close to over a month puts the account now in dispute. And with the added evidence that you have been paying your proposed payment on time every month for the past year will make Nationwide look rather avaricious in the eyes of the CC judge. If they want addresses tell them to find their own. A bit blase on the part of Nationwide to assume they will get an Instant charging order before a court hearing. Sounds like more pugnacious hot air from a creditor who considers its self as some kind of supreme being. Let 'em have their moment I bet you will have the last laugh.

Thank you, I didn't send the in dispute letter as I ran out of time with court dates, will request redetermination hearing if need be. Yes, you correct. They ignored me CCA request, I shall ignore their letter.
Second and final LBM 01/01/11 Nearly got there but fell of wagon. HAVE to do it this time

Should the need arise though you could send this to them.

    Dear Sirs,

    Account No:

I refer to my letter dated XXXXXX in which I made a formal request under the Consumer credit act 1974 sec 77-79 for true copies of the regulated agreement refered to in the above account number. You are reminded that you are obliged to supply these under sec.189 whether you are the original creditor or not. I also enclosed the statutory fee of £1.00 for this account.

To date you have failed to comply with my statutory request and have defaulted in respect of this account. Additionally this alleged agreement is unenforceable until such time as the default is removed or enforced by a court of law. It is a further offence to attempt to enforce this alleged agreement until such time as the default is removed.

Consequently I am ceasing all payments to your company until such time as this matter is resolved. It is also my intention to report this matter to the appropriate enforcement authority.

    I await your prompt response.

    Yours faithfully
    Sign Digitally

Oh yes I forgot The statuary time for the original CCA request is 12 days + 2 not 14 +2 ( my mistake as I have not fully woken up yet).

So, this morning we get a bank statement from the old OD account - telling us that someone has paid us £166. Not sure who, or why, but it's annoying. On the one hand 'good' as it means the OD is a little less but 'bad' cos we need that money. I suspect Mr BR might want to go and take out whatever money he can and bring the OD up to it's limit again, but of course we can't do that. It's too early for it to have been the CCCS as they haven't taken a payment from us yet. Would the bank let us close the account if it's got an OD?
Also, the bank has sent a note, in with the statement, asking if Mr BR might like a loan....*sigh*...they have no soul.

:wall: Too Shay, I arrived home last night to a letter from American Express 'You have been pre approved for a platinum card'.
You just could not make it up could you? Pre approved obviously without checks because if they had they would have seen two defaults on my credit file and a score of about minus 100.

    Hi All

    Happy New Year

Just an update on my dmp start up, well bank account, wages and direct debits are all sorted. My first payment went to cccs on 1st Jan.
I have 13 preditors and have only heard from 4 of them so far.

    Studio have refused my dmp

Capitol One wanted me to sign a letter - ummm no.

HSBC said that my signature doesn't match the one they have on record so go to a branch and give one, surely if this were true then they shouldn't have been cashing my cheques because my signature is exactly the same, I have a feeling that they just want to humiliate me further, well tough they are just getting another copy of the cccs template letter, cccs did tell me to go to a branch to give my signature but my nearest is 15 miles away.

Next have said that they will agree to my dmp as long as I sign a new credit agreement - umm no.

The rest have just sent usual statements and letters saying I haven't paid my minimum payment.

So that's where I'm at, hope I'm doing the right thing in not giving anyone a signature, it feels quite quiet at the mo, well that's prob because I spent dec sorting out banks and Christmas.

I am feeling quite positive at the min, I'm sure it won't last, but I can honestly say today is an ok day.
