    Next have said that they will agree to my dmp as long as I sign a new credit agreement - umm no.

    The rest have just sent usual statements and letters saying I haven't paid my minimum payment.

    So that's where I'm at, hope I'm doing the right thing in not giving anyone a signature, it feels quite quiet at the mo, well that's prob because I spent dec sorting out banks and Christmas.

    I am feeling quite positive at the min, I'm sure it won't last, but I can honestly say today is an ok day.
    :beer: Excellent Joyanne, I'm glad you feel everything is moving forward. Creditors asking for signatures and wot not are just tactics employed by money lenders. I would suggest that you do not sign anything and do not discuss any thing via phone, letter communication only. If you telephone they will just try and back you into a corner and persuade you to give them more than you can afford with lines like 'you must pay you arrears before we can consider your DMP' etc. Also letters are traceability evidence to avoid any doubt when referred to later on.This is one of the main reasons I preferred to sort my own DMP rather than use CCCS etc so I can keep track on whats being communicated and act promptly to suit.
    I'm in the process in helping a work colleague sort out a self managed DMP, where she communicated with creditors via telephone and two of them in turn supplied incorrect bank account figures to enable her to set up and pay the agreed standing order payments. Now they are going down the CCJ route because they say she has not payed anything after they agreed to the proposed DMP and obviously there is no written proof to construct any defence. If creditors agree to anything and supply account details for making any payments best to get it in writing. They will try and trip you up and go back on their words. None of them are to be trusted especially DCA. I'm sure and you would not want your signature photoshopped onto some Mickey Mouse document. Its been done before Im afraid.
    There are better things in life than worrying about money…like nailing a jelly to a tree for example.

    Oh no....Mr BR sent off a letter to Capital One who had written saying that they couldn't do anything without his signature. My heart has just dropped - this was the wrong thing to do, I'm guessing.
    Capital One are also the guys who have sent us a default notice, so perhaps the letters crossed over, but will this cause problems now he's sent the letter back?

    Bizzare that, Crapital One said to me that if I had used CCCS to construct my DMP then every thing would be fine and dandy and all charges and interest would freeze and the plan would start immediately. Because my plan is self managed they demand proof of earnings and a bank statement and until they receive them the account will run as normal ,obviously with all charges and interest active.Company policy apparently but It looks like its one rule for one and a different one for another. Delay tactics I'm afraid in order to continue to ramp up charges and keep you hooked for longer. Stand your ground and be stubborn and just carry on making the proposed monthly payment, I intend too and I bet they will come around sooner or later.
    There are better things in life than worrying about money…like nailing a jelly to a tree for example.

However, if we stopped the DMP within 28 days then they would withdraw the default. This came with a letter saying thanks for letting us know about your DMP and they'd send a letter with reduced payments and stuff to our 'third party' management people (CCCS) - but this was after the 'we can't do anything until you return your letter with a signature on it' letter. I suppose the fact that we've had the one acknowledging the DMP then the previous one doesn't matter as much?

    Yes BR, this sounds like the many different departments @ Capital one not communicating with each other. The letters you send get passed on to another relevant department for processing, while in the mean time another dept unaware of your initial communication churns out a common generic letter, because a system flag has highlighted that the account is in arrears. And so on. I'm sure everything will settle for you soon enough.

    You'll find that some of the letters you receive in the early stages really don't tally up / make sense when considered together. It all makes sense eventually, as Mally says, different depts not knowing what the others are doing or, maybe, not knowing their @rse from their elbows!

    Anyhow, a word of reassurance - we found Cap One absolutely no problem to deal with. They were totally fine, accepted the DMP, no % since and we've settled our smaller debt with them on a F&F.

    You also might get letters from creditors flat out refusing the DMP, MBNA did this to us which was scary as it's my biggest creditor (over 7k), but, 14 months on they're still accepting the payments on our two accounts, through the DMP and have not charged any %.

    I totally agree with you my friend, I owe what I owe and are fully prepared to pay it all back. But on my terms;) and with out all the execrable interest. So they best play nice.:p

    Just goes to show, doesn't it, as these guys were fine with our DMP, have frozen interest and charges (debt just over £8k) - although I have been warned by CCCS that just cos they're saying this *now* doesn't mean they'll still be saying it in, say, 6 months time.
    Atm, our DMP will last about 8 years so they've plenty of time to change their minds.

    Whoopee !! Got my first two letters since sending in CASHflow statement through the door today. Both from MBNA for two different accounts, one debt is huge, the other not quite so, but they have agreed to accept out offer of payment on both cards, freeze interest and no more charges !! I am so pelased. Now to sit tight and wait for the rest to answer !
