Needs some help
Just received a letter from Moorcroft Debt Recovery who have taken over my debt of £200 from NEXT. The letter states it is an INTENDED LITIGATION. Payment in full must be made in 7 days or by 26/4/11.
I have rang Moorcroft who were very vague.
They informed me that NEXT no longer accepted the DMP payment and have passed it on to Moorcroft to recover. I have informed them that I am with CCCS and gave her my ref number. I asked her what happens next and again quite vague but she said they may accept payment or go to court. Not very clear need to speak with CCCS on Tuesday. She informed me that they have not bought the debt but are just acting on behalf of NEXT. I did tell them that the amount due on the letter was wrong and I disputed the balance but she did not seem to bothered she said I would need to write to them about the disputed payments and prove I have paid.
Think I will drop them a letter to support the call and contact CCCS.
If they want to take me to court for £200 so be it, but I am a bit worried.
Anyone had similar experience with Moorcroft?

Hello everyone
I haven't been on here for a while but my DMP is going good.
I've got a review to do but even though some areas have increased others have decreased so I expect my payments to go from £154 to about £200 which will knock the time to pay creditors down.

Just seen your post mikon. Initial thoughts are is there a minimum amount you have to owe before they can take you to court? Have to check that out.
Personally I would welcome court intervention as Next or whoever will have to accept the payment level set by the courts - not all bad.DMP member no 390

Sadly two of my debts are with Moorcroft, we did manage to come to a resolution quite quickly, without going to court. I received similar letters from them. I have also had issues with debt being passed on where i have disputed the debt.
I know how horrible it can be to get these letters and I have found the national debtline very helpful. I know you are using CCCS but you may be able to get help/advice over the holidays.
When dealing with Moorcroft I have just been very poilte but firm and explained that unless I had to go through this process I wouldn't because it really isn't fun. I have also found keeping a record of all my dealings with firms has been helpful and when they have acted unfairly/inappropriatley I have not been afraid to suggest that I will be taking action with the financial ombudsman.
Anyway - I make my payments and no longer hear from Moorcroft apart from the odd letter offereing me reduced price to settle the debt.0 -

Hiya and welcome, good to hear you're dealing with your debt, and although things will be hard, it will be a relief that there is a finish in sight!

Hi All
Letter sent to Moorcroft outlining my financial situation and informing them that I am DMP and that CCCS are authorised to deal with my financial affairs and therefore they need to be dealing with CCCS directly failure to do so contravenes the Lending Code and OFT Debt Collection Guidance.
Also enclosed £1 and requested copy of original credit agreement and a statement detailing payments to date.
Highlighted that I am in dispute with creditor regarding the outstanding balance.
Pointed out that I had received letter from creditor a week ago agreeing to a further 3 month payment plan.
I have also included the template for door step visits advising them not to visit my property as they will be breaking the law and that if they wish to visit then they need to make an appointment I have no intention of making such an appointment.
I have informed them that I will continue to pay to them what I paid to the creditor via my DMP.
I have asked them to respond in 12 working days in accordance with the CCA.

I am not having a problem with most creditors, although some officially not on board with DMP yet.
A few weeks ago I received a horrible letter from Nationwide re: my credit card saying I had to pay or they would default me.
Default doesn't bother me, but then I read how aggressive Nationwide are on other threads, I thought (in my moment of stupidity) that it would be better to pay the arrears. So I wrote to them and offered to pay arrears for this month on 28th April when we get paid.
Now, my dh has just found out his job is at risk, so we are stuck and are struggling to afford the arrears.
Is there anyway out of this one, or will I have to pay the arrears like I promised.
I owe them £4500 and the arrears are £240.
I know I should not have offered them more. How long does it take to take a person to court for a CCJ?0 -

Took them about a year to take me to court - search for my posts and you will see my journey - I too found them very aggressive :mad: as did the judge :T - he told them so and found in favour of me on both counts!
Not sure how you stand now but the mantra "only pay what you can afford" is one that rings true - if you find you cannot afford it then they will have to accept what pay and can take action if they so desire.
good luck - remember as long as your circumstances re inc/exp are reasonable and transparent then any CCJ action :eek: is only likely to benefit you - scary as it is0 -

I do not know why they act like this. No other company seems as bad as them. Their website makes me laugh, promising to help if you get in trouble.
I am just worried I have got myself stuck now I sent that letter promising payment. What could I say to them. Mind you, does it make any difference - they don't listen.
Thing is we are just treading water as we getting injury compensation which could pay off all debts, so I was thinking it may be worth putting up with the wrath of Nationwide until the money comes through by Nov at latest0 -
Looks like Halifax have accepted as stopped interest on last statement. :jDo some companies not inform you?0
