    Hello to everyone. We have received another 2 responses to our initial letter - one suggesting we would be better off dealing with them direct (don't think so!) and another not mentioning the DMP but providing a breakdown of receint payments and a current balance - so 3 replies from 32 so far.

    All the big bills have now gone and although we have a very little left at least all the priority stuff has been paid, both cars are full and OH's has now been serviced, taxed and MOTed _pale_.

    ShellShock - they can't call you whenever they like. Send these two letters:

    Letter 1:

    I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.

    I have verbally requested that these stop, but I am still receiving calls.
    (Delete if necessary)

    I now require all further correspondence from your company to be made in writing only.

    I am of the view that your continued harassment of me by telephone puts you in breach of The Consumer Protection from Unfair Trading Regulations 2008, and the Protection from Harassment Act 1997.

    If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

    Please treat this also as a formal complaint under the procedures set out by the Financial Ombudsman (FOS). As such, you are required to send me a copy of your company complaints procedure.

    Furthermore, please note that the FOS
    consider it 'unfair' for you to continue with phone calls when requested not to do so.

    Be advised that any further telephone calls from your company will be recorded.

    Letter 2:
    FAO: Data Controller of (creditor/DCA) - Section 10 notice under the Data Protection Act 1998

    I withdraw my consent (under s.10 of the DPA) for you to process my personal data with respect to my personal or work telephone numbers registered with you or stored on your systems/records.

    The processing and use of these numbers is causing significant distress.

    Advice from The Consumer Credit Counselling Service and the Information Commissioner indicates that your retention of contact details in the form of a correspondence address is sufficient to fulfil contractual obligations.

    This request supersedes any contactual provision that you may claim exists, and any attempt to claim otherwise will not be accepted or tolerated.

    Under the DPA you have 21 days to respond to this request, and 28 days to cease processing and/or remove the data from your systems. Future use of my telephone number will be recorded and will indicate a breach of my request under the DPA, this will result in a complaint being raised with the Information Commissioner.

    You will be deemed to have been served notice of my request and I will deem it served by (FULL DATE), I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence.



    Hope this helps - I have sent it off to a company who kept trying to call me at work.

    Dont wish to rain on your parade...Halifax CC have reinstated reduced interest charges for December/January..@ 1%..after no charges until now..4 payments by CCCS.
    Asked them why...reply CCCS are paying more than the contractual payment and therefore debt is affordable.
    I asked them if I should pay less then..reply we do not reccommend that...
    Anyone else had this kind of experience with Halifax?

    We sent letters to the Halifax last week 4asking them to freeze interest on the 4 credit cards we have with them, got a letter back which didn't answer our question about freezing the interest charges and when we rang them yesterday we basically got 'nothing we can do about it'...I appreciate that we got ourselves into this mess but wish that the companies would realise that we are trying to pay this back and face up to what we owe..not run away..

    I've mentioned before that this seems to be standard practice. If you can afford the minimum payments, then in theory you could come off the DMP and go back to paying minimum payments. Forever. :(

    Well thats everything in motion now :j.

    I've just received my email from CCCS about our DMP and so now have to get all proof of income etc.


    It has a clothing allowance for DS, an allowance for dentist/opticions and even an emergency fund :eek::eek:. We haven't been able to afford any of these things for ages.

    I also got 2 letters from LLoydstsb about our cancelling the DD for the loan and one from my CC saying -

    "thank you for telling us you want to close your credit card account ( i didn't, they did). We always recommend that you make more than the minimum repayment to reduce the amount of interest you pay. You can also pay off the amount in full" :rotfl::rotfl:
    If I could afford to pay it off in full i would't be going on a DMP.

    Feeling positive for the first time about getting the debt paid off. This has all been the biggest kick up the bum for me and i really needed it.

    So my job today is lots of phone calls and job hunting for a 2nd part time job.

    I know this is going to be a really hard slog so i'm going to enjoy my happy mood while it lasts.

    Afraid not, but they did appear to be paying ball initially. I'll just hope they pass it on soon as its more likely to get the charges stopped.
    They aren't obliged, just seen as good practice. Worth a try though

    Well have sent off all docs to cccs regards to DMP and letters to my creditors informing them what is happening.

    i posted a soa on here about 10 days ago ....

    i have

    12k on barclaycard
    500 on creation finance credit card
    350 on aqua card
    1000 on capital
    5k on halifax loan
    1500 on santander loan

    so around 20 k but once my account and details on cccs site are there i will put them as a signature on my posts.

    so what do i expect to happen over next couple of months does it take long for creditors to respond to requests for interest fees etc and if they accept dmp payment..... have seen lots of posts about barclaycard not being helpful so bit worried about them as they are my biggest creditor by far

    all replies welcome !!
    dmp first payment april 2011 debt 23k ish debt free date june 2017 but am determined to bring this froward over time. The journey begins :eek:

    Following my LBM in August 2009 I enjoyed reading and contributing to Debt Free Wannabe. After some time away from the forums I have just returned and was pleasantly surprised to stumble across the DMP mutual support thread!:j I started my DMP with CCCS in Jan 2010 and am chipping away at getting my debt cleared. I look forward to reading all the posts and would like to say a big thank you for all your encouragement!:T
