Just wanted to say thanks to everyone on this thread.

Went to my husbands redetermination hearing and the judge changed the monthly repayment from the ridiculous £979 per month to £70, however the solicitor asked for the judgement forthwith so they can now apply for a CO which she agreed :(

So now just waiting to see what they do next, hoping that they don't try to force us to sell the house.

I'm so gald you are left with a sensible amount now. I thought they could only get a charging order if you failed to make your monthly payments?
Think this is in store for us further down the line as have big debts with Nat West.:( Wishing you all the best on this.

Will be keeping my fingers crossed for you. It's nice to see that some level of common sense is being applied (hasn't happened often enough!) and good to see a more manageable repayment structure being set. Would hope that your house will be safe

Very unlikely! do you have children? (if so more than likely improbable) - at present a charge will be added to the house (as it is with a mortgage) and if you default they look at enforcing it - all that depends on your circumstances etc... you will also get your day in court before it the CO could be acted on.

We have 3 children aged 2,3,4 but am more worried as our mortgage is also with NatWest - although we have not missed any payments.

Am worried that because we owe the whole of our property value to just NatWest that they may persuade a court to make us sell to repay them.
  • Hi Guys

I haven't posted in a while as my DMP has ran smoothly for a while, until yesterday

I have received a statement from Santander who took over my A&L Overdraft a few months ago, anyway the statement says that they will be adding £100 of charges to my account at the end of this month. My outstanding balance is only £200 and I have made all of the agreed repayments via CCCS. It seems as though they no longer wish to play ball. Anyway I've asked CCCS to contact them on my behalf and I am in the process of sending them a begging letter :). £100 of charges is more than half of my total DMP payment :( If these charges are added to my account then every payment I have made via CCCS will be totally wiped out. Just when you think everything is running fine, something always sets you back in this game.

  • Hi All.

Just a question really we had a letter from CCCS saying that Lloyds wont accept our DMP for our overdraft as according to them its in credit, I wish it was, lol. At the minute the only thing we have currently defaulted on is the loan so until our overdraft actually goes over the limit and we incur a bank charge then they wont accept the payment? Does anyone also know when the money is distributed to creditors through CCCS as I know they will take the payment on the 1st but when does everyone get it? xx

    Hi all,

Havent posted in a couple days just got an update really.

CCCS have been going through all our figures and have amended our monthly surplus from 1362 to £1296 as my wages from my second job can be very up and down. Their budgeting has really opened my eyes as I have never really been any good in that department!!!!! According to CCCS, we should be debt free in 4 years 4 months!!! The way I was going, it would have been more like 10 years lol and all cos we are pants at budgeting. The debt remedy has really opened my eyes.

I was thinking about carrying on going it alone as Egg and Virgin have been fab. Our problem is my OH Virgin card, Scalifax and his personal loan with Santander he only owes about £4,900 now anyway. I am getting harrassed by barclaycard like 6 times a day so Im wondering if I should just let CCCS take over and take the stress and worry away???? One thing I forgot to mention was that thanks to Scalifax being ok one min and the next being pigs, my OH has now got arrears of £1261.55!! which I suspect is mostly flaming charges. I have rung scalifax like 6/7 times and I always get the "we never received your partners letter, dont know what you are talking about" and I sent them recorded delivery! makes you sick doesnt it!!!

What do you guys think? I am still in two minds here!

    thanks
LBM: April 2009 - honest debt figure: Secured: £0.00!! (paid back april 2017) unsecured: £53117.48 (roughly) back with CCCS starting again:(

I'd go with CCCS (or PayPlan) as at least the banks work with them, so will have some kind of relationship already built up. That does help when negotiating the DMP.

When all was being setup and I still received phonecalls I could at least say I was in the process of going with PayPlan, and to provide a ref number. Most creditors were ok with that. And that's still the situation now (in that if any problems, I'll speak to the creditors in the first instance, then refer to PP if need be).

The payment is debited from your account on the 1st but the creditors receive it on or about (sorry can't remember exactly :o) 25th-27th of the same month.
So there is quite a bit of a time lapse.
