Advice needed - falsely accused of sexual harrasment

    I think this is a pretty good point.

    By definition, 'harassment' is something that happens repeatedly or continually - not in the 'one-off' circumstances described by the OP, unless of course he makes a habit of falling asleep on the train next to this same woman and his hand is in the habit of falling on this same woman's 'body part'.

    I'm not convinced that a charge of 'sexual harassment' would be brought by the CPS for the incident as described.

    Although the OP says:

    he's presumably copying them from the paperwork he (allegedly) received at the Police station
    I have a paper which says that they will file charges on 00 June

    So OP - is the charge 'Sexual Harassment' or is it something else?

    I think I mentioned incorrectly, it should be assault not harassment as I dont know the lady, let alone do something on a regular basis. I can certainly say my hand defo would not reach areas like crotch, etc those areas are way too far. Only the parts which are near when you are sitting to someone nearby like ankles, hips. I only woke up from sleep when some policeman woke me up. Whats upsetting that there were many people on the train, why didnt anyone say anything?

    The police says they will look at CCTV, I dont know what they will find out since it doesnt have audio and is black and white.

    All I can just ask from you forum members would be for you to pray for me. Prayers are my only hope since I dont have much faith on the legal system as you would read in news that people commit big crimes get away and those who do petty crimes get done for. I myself swear on anything that I havent done anything indecent intentionally.

    Even more unbelievable...you say you could reach her ankles and her hips but not her crotch! What's audio and B&W got to do with anything! How do you know nobody said anything...you were supposedly sleeping deeply enough that you didn't realise the police were in front of you!

    Harassment requires a course of conduct consisting of at least two incidents. What happened, according to the OP, would be a single incident, and could not be considered in itself to be harassment.

    Maybe he followed her (in his sleep) through the numerous carriages of the train (would he know if he was sleeping?) and accidently touched her more than once perhaps?
