I think you are confusing my point. BCS said that she was claiming compensation for depression, but that depression had not been caused by her treatment. My point was that either she had depression before (which it seems she had)and therefore cannot claim for that, or the worsening of the depression had been (quite inderstandably imo) caused by the results of the surgery and the issues sirrounding it.
The point being that if you get compensation for medical negligence then benefits paid for illness surrounding the claim are repayable. BCS said that the illness and the benefits are not linked, so therefore benefits are not repayable.
However, reading her posts I cannot see how they are not connected.
I'm not 100% sure but from what I read if you have claimed benefits as a direct result of the negligence then the benefits are repayable but I was claiming my benefits before I had my surgery so I didn't think they were.
I'm probably wrong but i'm sure i'll find out soon either way.I'd rather regret the things I've done than regret the things I haven't done.

Yeah, this is true. If you have an accident or due to medical negligence and claim benefits and are awarded compensation, you have to pay some of the money back.
I believe its the same with the likes of employment tribunals
if you are awarded unfair dismissal then any benefits paid can be claimed by the DWP0 -

I presume they will take account of whether you are likely to have recovered but if the compensation is in any way related to the conditions noted on your medical certificates I would assume you would need to repay. With industrial injury compensation the recovery is made direct not sure what happens with IB.0

I don't understand how you can't have reconstruction on the NHS but you can if you have it done privately - it's either possible or it isn't!0

Yes, I am well aware it is on the spectrum as I also have Aspergers as you know from a previous thread. There is no way in a million years that I will allow my condition to be classed as a disability. It does a gross disservice to those who truly are. Despite the distress and pain that it also causes me, I decide to just get on with it.
I clearly remember posting my story in another thread thinking that it might prove useful and inspiring, but all you could do was turn it into some sort of personal attack on you.

I have taught quite a lot of students with Aspergers and none of them would say they were disabled. They have difficulties, not a disability.0
