"This is going to be a "battle of the forms." If you offered to purchase the goods and they then accepted, or if they offered to sell you them and you accepted their offer, then the contractual position is that the goods must be supplied at the agreed price, or you should be compensated for your loss caused by the seller's breach.
However most websites will state in their terms and conditions that you do not agree to purchase the goods - you offer to do so. They then acknowledge your offer and accept it by despatching the goods to you - but not until that point. At that stage, if they go "sorry mate, price has gone up, can't sell them any more," then there's no contract and therefore no breach and no remedy.
Orange actually state in their terms and conditions that the contract is when the goods are despatched OR your money is actually taken from the bank (not pending but taken - meaning a transaction in your bank saying the firm who the payment is made to and them transferring the money back).
Read into that as you may but worth mentioning maybe!!!
But then the company is trying to use terms and conditions to bypass statutory rights which would put in in breach of trading standards. If anyone receives a statement from this company claiming that they can use such a clause they should report it straight away. The law is covered by primarily the UK Sale Of Goods Act and then also by
DIRECTIVE 1999/44/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL
of 25 May 1999
Article 95
(22) Whereas the parties may not, by common consent, restrict or waive the rights granted to consumers, since otherwise the legal protection afforded would be thwarted; whereas this principle should apply also to clauses which imply that the consumer was aware of any lack of conformity of the consumer goods existing at the time the contract was concluded; whereas the protection granted to consumers under this Directive should not be reduced on the grounds that the law of a non-member State has been chosen as being applicable to the contract;
In other words, it is against the treaty of Rome for a company to attempt to restrict the consumers rights. This is one of the founding parts of the treaty in regards to mutual member states consumer laws and over-rides all national laws and guide-linesFreebies you don't really need can be given to your local Hospice Charity shop so they can raise funds they desperately need. Pass on your good fortune :A0 -
When they have limited stock they should have limited the deals to 1 per customer (or) should have cancelled the bulk orders instead of cancelling those genuinely placed orders.
Many items which were sold for £8 are now floating in ebay all in 2 digits.
Just did a search on ebay and one seller has 4 of the satnavs available. The same seller also has the portable hard drives for sale. Coincidence?Awaiting a new sig0 -

Hello,
Thank you for participating in our latest 8 for 8 Pound offer which was run on last week.
We had overwhelming interest on the offers, which we did not expect and subsequently have now run out of stock and are unable to fulfil all orders.
We are really sorry but we have had to cancel your order.
Do not worry, we have not taken any money from you, your card issuer will have reserved some funds for us but
we are letting them know now that we won't be completing the order, you should see it showing as available funds very shortly.
We know it is not great news but we do run these promotional offers often so hopefully you will visit and shop with us again soon.
Please accept this 10% discount code : MG5BMMGG : that can be used on as a good will gesture on our behalf.
This code is single use and unique to you and if you can not decide right now, it will work up until the 10th June 2010.
Please accept our sincere apologies and we hope you will come back soon.
Kind Regards

Has anyone noticed a large increase in the number of e-mails in their SPAM box since this promotion!!!
I had the above e-mail from Orange yesterday offering me the 10% apology and after the time of the e-mail I had at least 10 spam mails from senders I haven't seen beffore.
May be just a "coincidence" but just wondering? We seek a world in which everyone with HIV/AIDS can live an abundant lifeWant to join us?0 -

I have had (not saying this is anything to do with Orange though) an email from Nokia Music saying thank you for your purchase of a download. Although the download was free actually someone has used my email addy to get it and registered with my email address. I have gone on the "forgtton password" bit and entered my email address and pressed "send" and it said the password would be reset and an email would be sent. I have not had any password email so maybe someone has got a reset password sent to their phone. Still makes you wonder!!!Has anyone noticed a large increase in the number of e-mails in their SPAM box since this promotion!!!

If it bugs you so much then report the seller to the inland revenue. If it doesn't bother you then just applaud their tenacity.
Having said that, I think Orange need to limit future offers in future to 1 of each item per mailing address or some other method of allowing everyone a fair crack of the whip.Lead us not into temptation...
just tell us where it is and we'll find it....0 -
Ha, hilarious. Maybe it's one of these people who also bought one of each "for the kids".
I know i spotted that already the GPS guy no selling a stack of 160GB Harddrives too... £40 a pop.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0
