    I just sent them a snotty email. It won't achieve anything, but it made me feel better! :p
    Regarding the people who are now putting their multiple orders on Ebay, I'm afraid that's just another example of the uglier side of human nature. Sad, but it's the way it is!
    (PS: I hope their sales fall through, or get lost in the post. ;))

  • Had my e mail at midnight this morning saying order cancelled OOS and the 10% discount code, I e mailed them back and told erm stick the 10% it was all a fake sale icon_smile.gif

    I ordered at 12.05am. Had my cancellation notice this morning.

    Many, many orders satisfied before & after mine. Some bulk orders also fulfilled.

    Just rang them & they told me it was out of stock & asked for the MDs name.

    Tom (Customer Service Number 5738) said he couldn't give it. I told him to check with his supervisor because it is a legal requirement. His supervisor refused to let him give the name.

    Whole world of trouble coming their way.

    What offence is committed by a call handler not giving the MD's name ? is it under the !!!!sed off customer act :rotfl: and what is the whole world of trouble ? possibly won't deal with them again, wow, just need to chill and move on, and if it's any consolation, I didn't get my orders filled, but did I really expect too ? nah

    somethings not right anyway, how can people who ordered at 12am be refused but people who wake up at 7-8am, log on, see the deal and order, get their orders fulfilled?

    they really ballsed up on this one. someone should email the MD a link to this thread (& HUKD's), it might give him more clarity as to the buyers thoughts of his company.

    I emailed back to say I would wait for them to get it back in stock and they said they were not getting them in again so I would have to have my money back. So, if we see them there again I shall complain.

    There is no legal requirement on a company employee to give the details of any director. The legal requirement is only to provide the contact details for the 'Registered Office'.

    As for whether a contract was formed between orangeaccessories, it is quite clear that the 'offer of sale was made without error (i.e incorrect price)' and that the purchaser completed the contract by offering to pay. By failing to supply, the company is in breach of contract. It is the companies responsibility to ensure that when the stock runs out, that they cease offering to sell. In failing to do this, they are legally obliged to supply the goods or they can be sued for damages due to the breach of contract. What damages a court awards is unsure, but it is likely that if an alternative supplier was found, the damages would amount to the difference in price that the consumer must now pay.
    The local small claims court is the destination that many should consider.
    Claiming that the funds weren't drawn from the consumers account is not a defense - the consumer by supplying their payment details completed the contract.

  • Just checked my bank and it looks like my money is back in ...
    I tried ordering twice which didn't go through.

    I don't really understand much about the legal side of this...
    But in my opinion, I think the only thing they did wrong was not honour the orders who ordered first (just to note, I wasn't one of the first ... I didn't place an order till about 10 in the morning!).

    They should definatly look into getting their website up to scratch if they want to do any more good offers like this. For example a live stock update would be a good idea! and a limit to how many of an item each customer can order.

    Just read this from another website about consumer rights on a similar matter and it reads

    "This is going to be a "battle of the forms." If you offered to purchase the goods and they then accepted, or if they offered to sell you them and you accepted their offer, then the contractual position is that the goods must be supplied at the agreed price, or you should be compensated for your loss caused by the seller's breach.

    However most websites will state in their terms and conditions that you do not agree to purchase the goods - you offer to do so. They then acknowledge your offer and accept it by despatching the goods to you - but not until that point. At that stage, if they go "sorry mate, price has gone up, can't sell them any more," then there's no contract and therefore no breach and no remedy.

    Orange actually state in their terms and conditions that the contract is when the goods are despatched OR your money is actually taken from the bank (not pending but taken - meaning a transaction in your bank saying the firm who the payment is made to and them transferring the money back). All these people saying they have had their money back most probably mean their pending payment money is actually available again in the bank and not that their transaction has been reversed. NO money is taken until the goods are actually dispatched. IF money has been taken and you can prove it was taken via your bank statements then you have a case, otherwise as I read you have none.
    Read into that as you may but worth mentioning maybe!!!
