No mate, the spitting. Spitting is assault. The guy who spat on the candidate may have been provoked, but you can't argue it is self defence or proportional to spit on him, ergo he assaulted him.It's getting harder & harder to keep the government in the manner to which they have become accustomed.0 -

I hate the BNP for the racist scum that they are. The BNP fella was clearly inciting trouble by shouting stuff over the road. When the lads came over he didn't want to know anymore and tried to frighten them off with comments about there being more of them. However in his defence (and I hate to do that) I would say that most people would lose it if somebody spat in their face. I would say the police would see the fight as six of one and half a dozen of the other. They might however have a word with the BNP about going around shouting stuff at people and inciting trouble in the first place.0

Deliberate spitting is assault!!!
I think all offences are still offences no mater of provocation or not.
those accused of murder and manslaughter can be aquited on a defense of provocation but not assault. although it can influence sentencing.
provocation is a defense in other countries such as the states.
