those accused of murder and manslaughter can be aquited on a defense of provocation but not assault. although it can influence sentencing.
provocation is a defense in other countries such as the states.
in this case i might say the (uk) law is an !!!. clearly if provocation is a defense for killing someone it should be for spitting on them.

Ok can we all please agree:
1) The BNP are scum
2) Spitting is gross
3) Spitting on the BNP is in theory a protest at their god awful politics but in actuality, still gross, potentially illegal and fundamentally a waste of useful enzymes.

We live in a democracy, the BNP are a political party with hundreds of thousands, if not millions of voters.
These candidates are just expressing the views of the party and the people they represent.
That is the result of us living in a democracy.
I personally don't support the BNP, but they have the same rights as every other party.
If you don't like them, ignore them, don't vote for them.0 -

Is that still not diminished responsibility? (still likely to get maslaughter don't forget murder is premeditated not defence)
Not even you could believe the man today would of got off if he murdered him instead of spitting on him.

They may be aquitted, but will still be charged with alternate charges such as manslaughter, or guilty on grounds of diminished responsibility, therefore still guilty...
Whilst I understand your point, & my dislike for the BNP is high, the lads spitting were wrong & should be charged accordingly. ninky, do you think they were in the right or wrong?
if you believe in freedom of speech, you gotta hear things you don't wanna hear...It's getting harder & harder to keep the government in the manner to which they have become accustomed.0 -
