They are termination fee's, has he recently been disconnected for nonpayment of his bill?

You need to ring up customer services and get it sorted sharpish so they can stop the direct debit being taken. You can phone on his behalf if you have his password.

No he has only paid one DD so far and that was taken fine from our joint account...

The reason he had to pay a deposit I think was because he's just a student and never had a phone contract before.

I understand we won't 'see' the deposit again but I mean O2 might keep it for themselves if they say we have 'breached the contract' by cancelling the DD

We have not cancelled the contract either

    I hate bank holidays!!

O2 are open over the bank holiday, if you know his password phone up and ask why the account has had termination fees raised against it and get them to put it into dispute now, if you don't do it tomorrow there is a chance they can still take it.

Firstly, you WILL see the £150. It will be reduced off your bills after 3 months, or they will send you a cheque for the £150 if you ask them.

Secondly, as others have pointed out, it seems as if O2 have shown the charge for the whole 2 years of the contract on the bill. £30 a month x 24 months = £720 minus the £150 deposit = £570. Isn't that roughly what the bill is showing? I'm sure that if he speaks to them, they will sort the bill.

Thirdly, if for some reason they did try and take the whole amount, the bank are obliged to pay it straight back into your account under the Direct Debit guarantee system as soon as you tell the bank that there's a problem with the DD. I wouldn't advise cancelling the DD as that could leave your BF in breach of his O2 contract, and he could end up screwing his credit rating.

O2 messed my contract up completely. They charged me termination fees for a contract that was cancelled within 14 days, promised not to charge me and then took money from my bank via DD.

I got my bank to refund the DD. Then O2 refunded both me and the bank! They are making it really difficult for me to give them one of these refunds back too!

It has taken weeks for them to understand their error and it is only my bank that have made it clear to me what O2 have done.

I have very little confidence in O2.

Cancel the direct debit then ring up and make a manual payment for the amount you think should be charged this month (I'd pay the £9 for texts and argue the toss later) so you avoid a late payment mark on your BF's credit file. Dispute the remainder of the charges in writing (e-mail or recorded delivery) and keep paying what you think is owed each month. You might get late payments marked but they can be removed when 02 agrees they have made a mistake - if you pay nothing you are definitely in breach of contract. I had to ring and make a payment on my ex's contract with Three, they wouldn't actually confirm the amount owed due to data protection but they would take payment!

Hi, can I suggest you call him and get him to call O2. He won't need to pay anything for calling him as these are exceptional circumstances brought about by their negligence. If it costs £20 for the call then they will be obliged to credit that back to him. The other option is to call your bank and cancel the direct debit. I don't know if there is any form of secure messaging via the O2 billing website but if so you could use that as you obviously have his login details.
