There is no such thing as in "buying in bad faith" I can only assume it is the posters presumed antonym of the term "In good faith" the only offence that could be conceivably considered would be obtaining of a pecunary advantage which in any event would have been preceded by the offence committed by Tesco in overcharging the customer in the first place, the only time the customer becomes aware of the charge incurred for the product is at the till, the burdon would be on the complainant to prove the customer was aware that the overcharge was about to take place and did nothing to prevent or bring it to the vendors attention and then the proof requirement would have to demonstrate premeditation ie the customer actively seeking out a mispriced item, it would be difficult if not impossible to use any posts on this forum to back up an allegation but it may provide a circumstantial link. Tesco having committed the original offence could be said to be responsible for any subsequent offence, could with a little skill be demonstrated to be an incitement.Four guns yet only one trigger prepare for a volley.Together we can make a difference.0

However, how do Tesco's prove that he is deliberately R&Ring? You say that BASSMANs previous posts would highlight his intent & character. How can Tescos link the two together?
Also, his actions were probably not recorded at the stores he visited. As they seldom are in my extensive experience. The only record Tesco would have is that of a name and postcode and that would only have been supplied by himself, if they even asked. I have only been asked once ever and that was today when I got a load of R&R's. Further more, there is probably no CCTV footage of him as the SD or the CCTV Op probably didn't even notice him doing anything suspicious apart from being a shopper. They wouldn't have called the police either until a provable offence had been committed.
And finally, there is no link on r&Rers between stores.
I must admit I have always been a bit blase about this, as really
I thought I was doing nothing wrong....I have ALWAYS been asked to leave my details .....and as I pay using a Tesco Credit card...it seemed pointless giving a false address.......so really they could (not could have) get all my details together....
Re Security.....After the manager had gone to see the security manager, I lost track of my goods on the CS counter, so picked the bill up to save it disappearing as well.........At the end of the discussion, when I opted for the full refund(without the goods)...the CS guy asked for my receipt which I thought was with the goods.....The security manager IMMEDIATELY remarked that I actually had it in my pocket.......He must have been watching me while talking to the duty manager........0 -

You are entitled to a full RnR.....read them their policy if they argue.0 -
called tonight bought gigapack psp £219.97 and cars game for £29.97 (alth SEL said £32 odd irrelevant).
sorry long post but may save people searching for xbox offers, and claryfy psp offer.
NO £10 off at till.....paid £249.94 should have been £239.94. told to collect from customer services.
Couldnt find gigapack in safe so I asked could I have base unit instead.
He agreed and refunded £70 (the difference)
Left shop - returned and said "think I been overcharged" if I purchased both together then £10 off.
Claimed offer only for normal and he would need to rescan - as no normal on display, i said it states PSP consol not the normal one only , anyway he agreed to scan core system and special addition xbox 360 , with the prey game, to prove it was just for consols not packs which deducted the £20 on both :-)
When he scanned the normal PSP or gigapack with the game - no £10 off.
(so I should have had my £10 off on initial purchase)
Duty manager wouldnt make desision on R&R after i pointed it out when they offered £10 back....phoning tommorrow after discussion with store manager.....hope I get it now - fingers crossed.
Offer on PSP and Cars game said week commencing 25/08/2006 so other stores may not discount also.....hope you bag some.!!!!
will I be offered the game for free or the lot or nothing !!!!! any thoughts ??0 -
Blacksheep1979 wrote:Hi guys
Am new here and decided to lose my R&R virginity today and managed to find a bargain with some lamb leg steaks - scanned wrong, went through the till wrong but when I went to CS they refused to refun saying I had healthy living steaks and the price was for normal ones - even though the price was on the shelf by the ones I picked up. They said it was a mistake on their behalf and as a matter of goodwill (this after me muttering about trading standards and mispricing) would refund the difference. I dug my heels in and pointed out their policy and the manageress still refused. Anyway I got a full refund (after giving them back) and have emailed head office. Am quite peeved by this. Now realise I should have maybe kept the steaks and got refund from head office.
You should most certainly have received r&r, ok if they had been pork sausages fair enough the product is blatantly misplaced, but lamb steaks are lamb steaks to most people it is up to the vendor to be descriptive not the shopper to be discerning.Four guns yet only one trigger prepare for a volley.Together we can make a difference.0 -

Wow Thanks0 -
it wasn't like they were just lamb steaks - it was lamb leg steaks and thats what it said on the shelf, however manageress claimed mine was healthy living and the price card wasn't - hmmmm. Anyway will see what head office says.
But it may be worth looking out for others as it may be the same in other shops0 -

Wholeheartedly agree my learned friend, I couldn't have said it better myself.
Really I couldn't!!! I just know that Tescos are wrong and I am right.

Seen quite a bit on the misprices thread about people spotting out of date price SEL's.
How do I tell if an SEL is out of date? I assume it has a date or some kind of code on?
So if I find an out of date SEL, I should then use the price scanner to see what it scans at and then get R&R if it is scanning at diff price to SEL???!?!
Thanks
