    I trust my family including my brother 100%.

    Clearly this was a mistake. Hopefully one you won't repeat again. A thief who would steal from their own brother and put that brother's job at risk clearly cannot be trusted.

    Oh fgs the OP can think about punishing the brother AFTER he deals with the mess he finds himself in.

    The only thing I would do willfullly is offer to be dismissed rather than seeing my bro to prison IF it got to that. Work is work. Family is family.

    People make mistakes in life and you have to live and learn from them. My brother made a very dumb and costly mistake and I am sure he has learnt his lesson.

    Theres only so much I can say to express my disgust on his betrayal. I have already made him sell his consoles, computer, mobile phones and and use his savings to pay be back. He has accrued about £1700.

    Payback IS going to happen whether I stay or go. I am not one of those guys who is cheap, disloyal and thinking of doing a runner - this amount is going to get paid no matter what.

    I just pray my company can side with me and accept the repayment without putting me in the firing line.

    I was pleased to see that you have made him understand the consequences of his actions, ultimately although family is family that doesnt give anyone else the right to stab you in the back.

    Personally I would be giving him a list of jobs he could do in lieu of the remaining money that he owes you as well - but thats just me.

    IMO if the meeting is informal then that sounds like the company is at least prepared to listen to your side of the story. From the companies point of view you have been negligent in the care of company property, and had that telephone had any client contacts on it possibly in breach of the data protection act.

    However, you sound like you have travelled a long road with this company so far and have hopefully come out of the other side of it, and good employees are difficult to find. To replace you will cost them time and money.

    A police report would demonstrate that you had not attempted to defraud the company. Otherwise there must be serious questions about your honesty, and hence whether the company can afford to continue to employ you.

    And don't worry: I cannot imagine that your brother would actually face prison for this.

    There is no question of fraud in this. I amnot silly enough to say "here you go bro, go and abuse it". I know IT policy well enough to know that doing something like that is fraud. This is not the case. My brother admits to what he did - end of. Everything else is pure speculation.

    When I first heard about this, I carried out my own mini investigation, found the facts and reported them immediately to the people that needed to know. Not once did it occur to me "Oh phone the police now and get a crime reference number". IF that should have been my next course of action, then why didn't my line manager and/or the Director tell me to do this? (remember everything was out in the open within 15 mins of finding out). They basically said, we will need to have a chat to understand what happened.

    Plus - I am not a mastermind of creating false information. I reacted extremely quickly in helping them gather the facts when being informed. Had I of come back to them say 2 hours later, then sure - theres absolute grounds of thinking this.

    1. The phone was robbed without my knowledge ADMITTED by the thief.
    2. It was not 2 months, it was actually 1 month
    3. The phone was reasonably secured in a drawer
    4. I know exactly what roaming charges are and how much they cost. I would be an absolutely dumb f*k for saying go on a £2000.00 joy ride BEARING in mind I am on a FWW and the number is linked to my name on work records. Also i'd be dumb to think, something like this would be overlooked. If I masterminded this, I would have passed it over and said, use it ONLY when needed. Sorry but I not even going to begin to entertain that idea because its not what happened and it is not me.

    Sorry but I am not that dense and the facts are as what I have described. I can guarantee the following will add up:

    1. My phone was exchanged in December - confirmed by IT guy
    2. Old phone was handed back - confirmed by IT guy
    3. Bills will show that all charges in 2010 for old number since Dec are Zero
    4. Bills will show that all charges in 2010 for new number were LOW except for the period he went away.
    5. Bills will show that my old numbers previous record of charges were 0.00 for about 5 months out of the year and when there were call charges, they did not exceed £30.00 max
    6. Outlook will show, that my personal number was distributed to everyone around Feb by the mail team admins in another country, which further justifies why I avoided using the work phone.

    Not bothered if you dont believe me but these are the facts and I am willing to fight them all the way because they are all I have to deal with.

    I might be delighted to have an excuse to get rid of someone who was irritating me and was already on a FWW.

    If I thought the employee was good at heart, and improving due to the disciplinary process, I might accept the story that he had been the victim of a family miscreant, and let him off (with stern words about the fact the FWW is still in place etc).

    I could tell them to dock my wages next month and thats the quickest I could get it paid back.

    They will probably do that regardless of whether they fire you or not.

    If I thought the employee was good at heart, and improving due to the disciplinary process, I might accept the story that he had been the victim of a family miscreant, and let him off (with stern words about the fact the FWW is still in place etc).

    Without blowing my own trumpet, I have worked very very hard at the start and after my FWW. Since my FWW, i have passed 4 high exams and have gone from becoming the least qualified to the most qualified in a 10 man team in less than 6 months - some of these guys have been in the company for 10 years (I have been here for 1 year). I have also cost cut and saved the company thousands, restored access rights that were orignally taken from me, been awarded a secret bonus and been given a pay rise that was so high that it had to be approved by people above my line manager.
