    Easy tiger. It was reasonable to pick up on this point as you have been saying all along that it was securely locked away and then suddenly it appeared it wasn't. These will be questions your employers will ask, I am sure.

    I've only read bits of the thread so apologises if I've missed something......

    However, a timeline of your disciplinary record would help. Verbal Warnings normally last up to 3 months, written warnings 3-6 months and Final Written warning up to 12 months. When did your 'problems' start and what where they?

    Further, as the phone was 'yours' (i.e given for the course of your employment), then I suspect that there would be a policy on 'personal use'. In this case, it has been used (although not by you) so why not simply cover this cost. Ideally, it may be beneficial if you make you offer explicit so that they know you intend to honour it. From the Company's point of view, they don't want to pay the £2000! If you pay it, then it becomes less of an issue. This way you would not be breaching any company policies (as you would be covered by 'personal use') and your employment would not be put at risk!!!!

    I would then issue your idiot brother with a demand for £2000. If he didn't pay I would then take him to court. If he has money to go to Dubai, he has money to repay you.

    In addition, I would had back the company phone so these types of accidents can't happen again (if you actually want to keep your job).
    This is really good advice however if you or your employer does press charges against your brother, his future CRB checks will flag up problem.

    Was the phone in a drawer under clothes or was it in the briefcase in a drawer under clothes? Be careful because this has come across as two different accounts and would look like you were fibbing to a sceptical investigator.
    I agree with those who advise you to offer to recompense the firm the full amount immediately (providing they don't sack you). Good Luck

    The simple answer is that you are responsible unless you go to the police and report that the phone was stolen by your brother. If you aren't going to do that, and I wouldn't expect you would, then it's your responsibility and you just have to hope that work are going to allow you to pay it back rather than take it to a disciplinary. As they said that they want an informal talk with you, I'd say it sounds hopeful.

    I think you're missing the point:

    If I was the employer I might want to report/expect the OP to report the theft of my property to the police. It may help them take the OP's protestations of innocence more seriously.

    OP all you can do is offer to pay back the money 1 way or another and apologise profusely and say it wont happen again and hope the employer decides not to get rid of you,

    re the location of the phone you should really be honest as to the location as in 1 post you told us it was locked in a briefcase and in another you said it was in a drawer so which is it as no doubt you will get asked this by your employer,

    to prevent anything like this happening again never tell anyone the combo for a briefcase if a works phone is stored in there

    ..and it already sounded dodgy before.
    Someone is taking the mickey? Testing a few versions of events? After all if MSErs fall for it, it's likely that the OP's employer will too...
  • Lets be perfectly honest.

    The OP will be sacked. The OP does not come across well and his story sounds extremely unbelievable, that coupled with his attitude and I would expect them to suspect he was involved in the incident far more than it just being his brother and hence dismiss.

    If we read the story through it really just isn't believable.
