Lost my phone :( (with orange)

Hi
I bought a SAMSUNG TOCCO ULTRA 4 months ago in Phone4u but the 18 months contract is with Orange of £35/month including insurance(luckily).
Now I have lost my mobile _pale_and have reported them immediately and have gone through all the procedures. They said they'll post my sim back in 3 days.
But the problem is now that they are out of Tocco Ultra and said that they'll inform about sending the equivalent phone to samsung tocco ultra.
But am really worried that they would send me a cheapest mobile.
So can anyone refer me some other phones, so that I can bargain them.
Oh, am so poor in choosing my phone :(
Please help me. Thanks in advance

They didnt call us today. So I was really worried and when I called them they said that the insurance company has closed the case stating that 'They have been careless. So they cant make a claim!!'
So the orange guy said that the insurance lines will be open only between 9am-5pm.

Am really getting mad now & have no clue about how to proceed.
My husband says that if they are too adamant to provide a phone its better to leave it as hes worried that if we claim a dispute, then they will leave a remark in our credit history (It happens & I read in another thread too!!! :() And whether it may affect our application to PR which we gona do it next year..

Please help me with this.. am clueless!!:cry::cry::cry::cry::cry:

careless isnt covered by the T&C's

however negligence is,what did you tell them happened when you lost it?

we said the truth that wen we were in city centre, I finished talking in my fone and remembered keeping in my jacket pocket. Then I removed my jacket and kept it on the pram, turned back and waited for my hubby to come and within few minutes the jacket itself is gone!!

I gone through the terms & conditions a few times before and worried that they quote
Apart from our home all the other places are public place, isnt it??
'3.9. Loss or theft from a Public Place
loss or theft of Your Phone when it has been left unattended in a public place;'

    3.3. Wilful Act or Neglect
    any wilful act neglect or failure to take reasonable care either by an Authorised User or carried out at the direction or instigation of an Authorised User;

i guess they are using these terms
