Well, I finally got my cashback from Tulip UK despite it being 8 months overdue. After writing and telling them I would, I took them to court via Moneyclaims Online for my past 2 lots of cashback and other extras they agreed to pay on my contract being taken up. I filed the claim online on Sunday, got the paperwork from the court on Tuesday, got a call from Tulip on Tuesday night telling me that had had 'financial issues' so payments were late and cheque would be in the post the next week. I did get the cheque 9 days after this call and I have my money!! I did however make sure the cheques cleared before cancelling the claim which I am doing today and wanted to make sure there was no bounceback on the cheques.
It took a couple of weeks but when you make your cashback claims make sure you keep all of your information and never send originals if you can help it, send all letters for your cashback (and copies of everything sent in the letters) by Special Delivery as then you are covered for the full amount should it go 'missing' in the post. Then when you make the claim you'll get your £30 back that you paid for your claim. I waited until the end when the whole amount was due and gave them the 28 days they tell me my payment will arrive in to pay me, if they did not then I'd take them to court for the whole amount (I did not worry about the interest, which was pennies for me). They didn't pay or contact me so I did. No reason why you cannot do this for your quarter due amount though - they'll soon get the message if we all do this. If you are concerned they are still trading check with Companies House to make sure you have the correct details. When you take up your contract, make sure you have all info on where the cashback is going to be sent to before your 'cooling off' period is due so you are ready to make the claim. If they can't give you the info don't take the contract.
It's time to start fighting back to get our money guys! As long as you have all the paperwork in order and have proof it was delivered in time then you have nothing to lose by filing. And a big thumbs up for Moneyclaim Online as without them the 'little person' like us has no easy way of fighting for what we are all entitled to!! I was surprised it all happened so quickly though.

I had a contract with mobile outlet with 12 months free line rental.
they need all the original bills to claim the cashbacks.
However the first two original bills were missing due to the incorrect address. I contacted my network--3, and they sent me a certificate regarding the missing bills and copies of the missing bills, then i wrote to mobileoutlet twice by recorded mail regarding this. In the end (about two months later), they rang me and told me that they'll accept the my copy bills for the first two months for cashback.(unfortunately, i don't have any evidence of it. All i did was that wrote down and time and date)
now I sent my cashback claim, and they wrote back that as stated in the terms and conditions, i'm can't have the cashback due to the first two copies!
I'm thinking to take them to court, but not sure if I'd win.
So wondered what's your advice?Any help would be appreciated.

From my experience, when I submitted my claim all I had to do was put down what I was claiming for and at that time no evidence was required. I would write to the company again and tell them that you had spoken with them regarding the bills and that you was told by telephone that this evidence was acceptable and you are giving them 28 days to pay your cashback or you will take further action to recover monies due. Also that you have stuck to your side of the contract you had taken with them by making your payments on time and in full and have evidence to prove this.
IF it ever gets to court you will have the evidence from 3 and your bank statement showing the payments were made in full and on time. You have your bills and evidence of the move of address so I would go for it. If you want a copy of the letter I sent them then please PM me and I'll send it over. Personally I would say they won't bother to dispute it as this will then cost them if they lose, plus they'll have to pay someone to go to court, get the paperwork together, etc...
It costs you just £30 so if you have this then just do it and see what happens. The more of us that fight these stupid Terms and Conditions they put on us the better. If your bill (even if it was a copy) has come from 3 then it is an original as it has come from the provider and will tally up with your bank statement.
At the end of the day, it takes people like us with our experiences to tell others that yes it worked or no it didn't, if it works then others who have missed out in the past will know where we stand and we can start fighting back against the companies. I wonder how many people think they won't bother as they only have copy bills. I am sure that as any court will see it, you have paid for your bills in time and in full as they have asked. I think you have posted this elsewhere as well so I will post this reply on there as well. Good luck and let me know how you get on.
