That may be - but if you looked at the link I posted - there is advice and I bet if they are saying on their site that the EU care/reshedule/refund rules are in effect and one of their members are refusing then there maybe some complaint may make the operator change their mind.

Several MSErs stranded in the US have posted on here in recent hours.
If you are travelling with British Airways, then hopefully you're keeping in close touch (or are able to keep in cklose touch) with this carrier.
This is because although the UK airspace closure / open / closure situation has been necessarily a mite confusing, BA seems to have decided to bite the bullet -- though uncharacteristically, without any media publicity.
Currently there appears to be not one but an entire airborne flotilla of British Airways a/c heading eastbound from the USA / Canada towards the UK.
Departure airports are:
Orlando, Florida (1 flight); Los Angeles (2); Denver, Colorado (1); San Francisco (1); Houston, Texas (1); Miami (1); Las Vegas (1); Calgary, Canada (1); Vancouver, Canada (1); Mexico City (1).
All flights are London Heathrow inbound with arrival times scheduled from around 7pm to 11pm this evening.
As of this moment, all flights are on time and several are expected to arrive earlier than scheduled.
Quite what BA is doing in sending up so many eastbound long-hauls today is presumably explained by the carrier's certainty that there will indeed be 10 LHR landings tonight, and not 10 diverted-to-Gawd-knows-wheres.
Anyway. If this is a resumption of normal ops out of Continental USA then that's hopefully good news for MSE posters who've reported in from airports as varied as Orlando and Los Angeles. . .
. . . Though I'm bound to wonder -- with something like five more hours to go before the first of this BA "flotilla" is due to land -- if yet another shift in met conditions might mean it isn't LHR after all where everyone ends up tonight.

I phoned travel agents but they said they have 3 hour updates , im suppose to travel friday cant i just demand a refund or do i have to wait until im told.
Because i cant be expected to be told on the day of departure as i need to arrive early , i also have a car arranged and also someone has took time of work to look after my pets ...i need to let my friend know as she is coming long distance and as kindly taken time of work to do this... to be honest sooner just get a full refund instead of keep checking for updates all the time.0 -

I am due to fly to Miami from LHR with American Airlines on Saturday 24/04 returning 01/05.
I booked the flights and hotel entirely through Expedia.co.uk.
I have spoken to my travel insurers [ Wesleyan underwritten by Millstream] and they are not covering anything to do with the volcanic ash.
If my flight gets cancelled , are Expedia obliged to give me a refund on the entire flight and hotel package? Or just part of it? Or are they obliged to allow me to re-book for a later date?
I've e-mailed Expedia and tried to hold on the phone for HOURS to get through to speak to them to no avail.0 -
Statement on Icelandic volcanic eruption: Tuesday April 20, 1500
The situation regarding the volcanic eruption in Iceland remains dynamic and the latest information from the Met Office shows that the situation will continue to be variable.
Based on the latest Met Office information, part of Scottish and Northern Irish airspace including Aberdeen, Inverness and Edinburgh airports will continue to be available from 1900 today to 0100 tomorrow, Wednesday 21 April, and also south to Newcastle Airport. Glasgow and Teesside airports will additionally become available in this time period. Restrictions will remain in place over the rest of UK airspace below 20,000ft.
Flights above the ash cloud are now permitted in the UK; between 1900 today and 0100 tomorrow, this will enable aircraft movements above 20,000ft in UK airspace.
We will continue to monitor Met Office information and the situation is likely to change during the course of the day. We will make a further statement at approximately 2100 today.
NATS is maintaining close dialogue with the Met Office and with the UK's safety regulator, the CAA, in respect of the international civil aviation policy we follow in applying restrictions to use of airspace.
