    double ditto to this, order placed, money taken, email received confirming order, I replied to email asking when order would be delivered, email received cancelling my order, money refunded, letter received yesterday saying order is on the way and should be delivered by august 30th. Well I'm away on holidays for 2 weeks on the 24th so if it comes then well and good.. doubt it though. "Cowboys Ted..."

    Debehnhams are still arguing that they can fall back on their "subject to availability" clause. They're talking utter b***ocks. They can only fall back on this clause BEFORE accepting our orders. By charging our credit cards and sending us invoices, they entered into legally binding contracts.

    This clause (number 2.5) in their T&Cs, and any attempt to invoke it, is totally unlawful under the Unfair Contract Terms Act 1977 because it gives Debenhams a unilateral right to alter the terms of the contract without notice after the contract has been formed. Nobody can not simply grant themselves the divine right to be able to vary the terms any time they like after the contract has been formed!!! (See the ruling made by the Office of Fair Trading against Kodak in 2002 when they tried to pull a similar stunt, and Kodak didn't even get as far as charging peoples' credit cards or sending them invoices like Debenhams have done!!! BTW - Kodak capitulated in the end.)

    In order to formulate my claim for Loss of Bargain I've tried to find a similar package on sale elsewhere, in order to calculate the difference in price which we are all owed. I think I've found it at Marks and Spencer's website:

    Soft Touch Dacron® 10.5 Tog Duvet, Product code: 01357103, Size: Double - £31.00
    Hollowfibre Quilted Mattress & Pillow Protector Set, Product code: 03480656, Size: Double - £25.00
    Pack of 2 Soft Touch Dacron® Medium Support Pillows, Product code: 01080117 - £12.00

    Total price of items £68.00

    Given the descriptions on Debenhams' website and the descriptions on M&S's website I believe these replacement items to be of similar quality and specification. The total M&S price of £68.00 is also very close to Debenhams pre-sale price of £70.00, which would serve to confirm this. If anyone thinks differently please let me know, as this is a rather crucial part of the claim.

    Hence I think we're all owed the difference in price of £59 by Debenhams.

    I'm giving them 48 hours to give me their final stance on the matter, after which I issue a claim in the County Court.

    They have been employing this tactic of confirming orders,then wrigling out for months,maybe a couple of years.
    See my warning post much earlier in this thread.
    It's time this pratice was stopped.It's unlawful.

    Still had no cancellation info from them so fully expecting this to arrive by 30th August as per their letter. If it hasn't arrived by 30th I will be asking when it will arrive, then following up on the loss of bargain rules.
    You don't get medals for sitting in the trenches.

    Today I have received another letter which states that the item I delivered is soldout and that I have been refunded.

    Ah well.. won't bother with Debs again for bargains!
  • Received my letters today stating money has been refunded and goods will NOT be coming. Would love to do the same and make them pay up for a replacement set from elsewhere. Would appreciate any help on content of letter we should all be writing to them. Just because they are a big firm, they don't have any right to just fob us all off because they choose to do it this way, its time they were made to cough up. I AM FURIOUS:mad: :mad: :mad:

    I really thought my bed sets were coming..They didn't take the money until yesterday so I thought they were being delivered for the 30th august as stated on their email...Just checked my online banking and the money has been refunded today..What's all that about...I knew I wouldn't get one..
