Double complete bed set £9 at Debenhams [CLOSED]

  • I ordered 2 bedsets, wasnt sure if the order went through so tried again, had 2 lots of £21.50 debited from my account, then had one lot credited back followed by a confirmation letter stating i would receive my order by 26th august(makes a change from all the 30th ones), noticed tonight i had been credited my other £21.50 so will wait and see if i get them. Is there no law stating that because we have failed to receive them despite confirmation emails we may be entitled to a similar product as replacement as they are in breach of contract?:mad:

    well i got a message to ring them so I did yesterday and it was a credit check..I don't think I will get them now as I am sure they are all sold out and I doubt they were holding them for me until they cleared my card which is strange anyway...oh well

    :mad: It's taken me over 24 hours to stop fuming enough to post that I was told on Friday that my order had been cancelled and monies already refunded to me last Monday! To date, I have received no letter(s) or emails to this effect.

    I called Fogarty direct (yes, it was an act of desperation) and was told that they sell that item exclusively to Debs online and they have none left in stock at all.

    Called Debs back to ask what was going on with their total lack of communication, only to be told that my order was still live on the system and due for despatch! 4 departments and a couple of hours later (!), order confirmed as cancelled, none available in any stores, no goodwill gesture, bad attitudes all round ("Well it's sold out madam, I don't know what else you want me to do!") and a lovely BT bill pending which will no doubt illustrate in monetary terms just how much time and money this abysmal saga of a non event has actually been. :mad:

    Big boo to Debs, and in dark vexation I went out today and got same set (albeit not Fogarty) from Woolworths for £15. I guess it was only £1.50 extra but it's not the point. :rolleyes:

    I should have calmed down sufficiently by tomorrow, having spent a night in my fresh new bedding, but Debs won't be receiving my custom again after this fiasco.

    Nuff said I think. :cool:

    Ow queer! Got the letter saying delivery will be direct, but checked my bank and it has been refunded!! I feel a call for loss of bargain coming on - if this doesn't appear I shall ask Debenhams to supply me with an equivalent product or let me source one elsewhere at their expense.
    The letter I have states VERY CLEARLY: "This letter acts as an invoice for the following goods..."
    You don't get medals for sitting in the trenches.

    You're absolutely spot on here. If this had been a misprice which we were immediately informed about after trying to place an order, they could probably have wriggled out of it as certain retailers have done in the past like Argos with their £2.99 Sony televisions. But they didn't do that - they processed our orders!

    There's no doubt whatsoever that a legally binding contract of supply has been formed by Debenhams charging our accounts and sending us invoices.

    Therefore my understanding is that we're entitled to sue for the loss of bargain which is the difference between the price Debenhams were selling this at (£9 - not sure if the postage comes into the equation??) and the lowest price we could reasonably be expected to source this item elsewhere. Since this item was exclusive to Debenhams I've no idea what a similar package of comparable quality might cost elsewhere - could anyone suggest a ballpark figure?

    One point worth mentioning: they do have 30 days under the Distance Selling Regulations to perform under their contract.

    I'll be firing off a recorded delivery letter to Debenhams tomorrow advising of them of my legal rights and my intention to start action.

    Has anyone else noticed how the invoice/letter from Debenhams doesn't have any postal address, VAT number, registered company number or phone number for Debenhams?! Unprofessional or what?!

    Want to know something even funnier... these were £12 (maybe £12.50) in Debenhams, The Moor, Sheffield on Friday...

    Now I've received the letter :confused:

    Thank you for your recent order. The goods have been specially ordered and will be sent to you straight from our supplier. This letter acts as an invoice for the following goods, the invoice number is shown at the top right hand side of this page.

    So that's: Placed order, money taken, money re-funded, letter received! madness!

    Not heard a thing yet. I have had a refund though. That was my 1st order from Debenhams & I can happily say that it is my last. What a shambles. The lack of communication is absolutely disgusting. I would have expected so much more from a company as large as them. Ahh well, least I know where my money wont be going next time no matter how tempting the offer.

    Thanks to the OP though, you weren't to know the great offer you posted would turn into such a farce.
