DMP Update:
Contacted CCCS today to see if I could book a review and was dealt with there and then. New adjusted figure is being implemented in june.
I had all my figures and we went through everything with a fine tooth comb even down to how many miles I cover per week. Anyway review completed and the new figure that is being sent to my creditors is £179 less than I was previously paying. I asked how the creditors would view this and I was informed that the figures provided on my budget were well within the expenditure guidelines and the creditors should be sympathetic. CCCS told me that the creditors are looking for consistent monthly payments rather than receiving bits and bobs each month.
I am pleased I have done the review the down side is my DFD has been put back 3yrs but this reduction is short term as my mortgage is paid off in Jan 2013 and I am expecting a pay rise next year so hopefully will be able to increase the DMP.
I have asked CCCS to emphasise this to my creditors but i am going to write to each creditor to explain each increase and the reason behind it so that they fully understand why the increases are necessary.
Finishing on a final note there was an interesting article on BBC News today about Debt Management Companies that charge fees and then do not pass the clients monthly payments to the creditors.
Thats my update no post today, bet it all arrives tomorrow and ruins my weekend . Tedsd has some good advice on how to enjoy your weekend do not open any mail received over the weekend until Monday.Mikon Riding the DMP Rollercoaster full of ups and downs but i will get to the end. :T:j

Actually no you're slightly out, to go down UE route is the easiest thing to do, being we never suggest it as an option until you're already at the "last chance saloon"; so you'll already be defaulted and you'll already be struggling to repay and most importantly, you'll already be hassled with creditors/dca's.
When you then come to us, we stop all this. Yea, you get the odd call/threat but we combat them. If you're in a DMP then naturally, stay on it, however if that will take 10 years to clear then why not consider UE as it'll be gone quicker....
Lots of pro's and con's - its personal to each persons situation!
Debt-Regret
Here is the scenario I would appreciate your views:-
Debt with Next Directory who i have been paying £5 per month via a DMP with CCCS. No signed CCA as the contract was drawn up online.
Next have defaulted me and handed the debt off to Moorcroft Debt Recovery. I have requested from both parties under Section 187 of the CCA to provide me with the original copy of the CCA they have failed to do so within the specified time. Moorcroft did respond informing me that the account has been put on hold until they investigate the matter.
I have continued to pay Moorcroft the £5 as I do not want to be seen as not paying, however Sect 187 states that if they fail to comply with my request they are committing a criminal offence. I have requested a SAR and as of yet have not received anything back from either Moorcroft or NEXT however the 40 day timeframe is not exhausted yet.
What I would like from you Debt-Regret is what is your suggestion now on this debt?
Any advice you can give would be greatly appreciated. I would like to add I do not want to go down this route but feel as if I am being pushed this way with this bunch of monkeys.
If anyone else has views on this matter feel free to pass comment.
Thank you in advance.Mikon Riding the DMP Rollercoaster full of ups and downs but i will get to the end. :T:j

anyone feel free to correct me if I'm wrong but ... if you were to try UE on this debt you would have to stop paying them which would mean cancelling the DMP as CCCS won't let you drop one creditor out - they all have to be treat fairly, also a lot depends on when the account was started.0 -

Thanks for giving me your feedback.
Just exploring my avenues. I am a bit like a sponge just trying to absorb as much information about debt solutions as possible.
Just knowledge is powerful in this game.

Maybe best posting on 'the site we don't name' - there's people on there all the time so you'd get your answer quicker
I can only go from what I've read I'm no expert (yet!)0 -
How much is this debt for? and what are you hoping to achieve by paying £10 for a SAR? If you are determined to keep paying and stay in the DMP, the answer is the same as it was last week, no point in asking for a CCA. and next are quite within their rights to ask someone to act on their behalf, and the letters from Moorcroft are computer generated and not worth worrying about and should be referred back to CCCS, no new legislation or case law this week to change any of that.

Pure Dead Dopey
I am aware nothing has changed on the Next/Moorcroft front since last week, however Debt-Regret has arrived this week and I was just wondering what his view were on this matter.
As for worrying about the letters, I'm not! I am just exploring what is out there and the mention of the dark side has intrigued me and I want to gain more knowledge about the subject.
18 month ago I would have been terrified to miss a payment to one of my creditors but over the past year whilst on the DMP I have gained so much info from you guys that I now feel confident to tackle my debts on my terms not theirs.
Just out of curiosity is the dark side the website all about forums?
Thanks again for you input have a good weekend.

Mikon! You have just achieved a lot with CCCS today, it's a bank holiday weekend, forget about all this for a few days - you can't give your kids money but you can give them your un distracted time - don't let the creditors take your family time also.
Take a break from it...

Just waiting to see what the ramifications are from the creditors when CCCS inform them that my monthly payments to them are being reduced. The bottom line is I need to live and at the moment we are existing.
Thanks once again.

Personally, you'd be better feeding the kids and looking after them, and then worrying about the debts - sod the banks if its a question of food on the table or your credit rating, no?
That's my views

Your spot on the info can be confusing sometimes. Apologises in advance but who is Niddy I here the name banded about but have never encountered him/her or seen any posts from Niddy.
