  • hi all , thanks for the welcomes. no - no notice we would get a collector calling around. we knew barclaycard had passed debt to them but total surprise to come face to face with some one on our doorstep. wasnt a big burly bloke or anything, a middle-aged woman very apologetic to trouble us! Still all ended ok.:beer:

    Hi everyone

    Here is the letter regarding people visiting your home save it to your hard drive. They cannot legally visit your home. The only people allowed to visit your home without invitation is

    The Postman/woman or a stranger asking directions.

    Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me over the past few weeks and these have been duly logged by time and date. Should it be your intention to arrange a doorstep visit, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

    There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

    MoneyMuppets - Well Done on your DMP. I had a surprise call too last year so had no chance to send the 'don't send someone round' letter but same as you, the chap was more embarrassed than me at having to call...

    Following your advice last week I used this to spend my Xmas money to buy my pressies. Don't laugh, they are even wrapped up already. Saved a packet and feels great knowing I could be in danger of not sinking!!!!

    Have a great start to this depressing week folks. As well as DMPs crawling along we can start looking forward to shorter days. Yippee

    dmp is going ok here, with one exception Natwest, they are still charging intrest after 6 months on DMP, others have stopped, including mint card,in the 3rd month (isnt this part of natwest) if so how have they stopped n not natwest?

    are there any templates that i could use (ive tried the one on the debtline website i think it was) that uses the office of fair trading rules (i think thats what it was called anyway), i think i read on here a while back ?

    I've got a Natwest and a Mint CC and they were both the easiest to deal with, both stopped interest (and defaulted me :rotfl:) immediately, They're my favourite creditors :rotfl:

    However Barclaycard where totally different - 3 separate accounts, 2 stopped interest eventually - the other still carries on charging me every month without fail. I sent another letter last week, I will wear them down eventually. But my point is I think the banks treat everyone differently and there's no set pattern they follow.

    There is a letter a few pages back I think - but I'm sure there'l be someone along soon with better writing skills than mine.

    I mentioned a little while back that Lloyds TSB had sold my account to a debt collector, got a letter of them over christmas offering me a 20% discount if I pay the account in full now. SIGH - if I had that kind of money stashed under my pillow I wouldn't be on a DMP!!!

    the letter from the debt collector was that a kind of a threating letter like "pay up within the next such n such days?" or just an offer for you for 20% off kind of thing,,

    It went along the lines of 'you owe us X amount however if you pay up within the next so many days we will accept 80% of that. If not we'll send the boys round!'

    It's the second one I've had, I had one way back when I only just started DMP from Crapone, offering something similar. Gives hope if anyones thinking of F&F offers nearer the end.
