Hello.
JUST received an email from one of the PD loan companies - Cash Genie. Do I need to worry or is it just a threat :-o. It really annoys me, but I HAVE called them 3 times to explain and they were ok, Ive sent them a £2.00 payment by postal order, emailed them and then I have just got the following... Any advice would be much apprechiatedx
Despite several attempts made by me to bring your attention to your account and offering you several amicable options to manage your account I have had no satisfactory arrangement in place. Your account has been neglected and is now due for further action.
Though I am trying to assist you and keep this from escalating to legal status I now have little option but to do so. Your account shall be assessed by our legal recoveries team and if your account is found to be neglected we shall apply for a County Court Summons via Her Majesties Court Service using there online system (www.moneyclaim.gov.uk),or passed to a debt recovery service amongst other avenues of legal recovery.
I urge you, do NOT ignore this e-mail, I am trying to help you in this clearly difficult matter. I am in a position to assist but to do so you need to contact me as soon as you are physically able.
If we have nothing in place before the date stated above I will not be able to assist you in any way and your account shall be escalated.
Please feel free to email or call me on free phone 0800 046 8121 if you have any intentions in repaying the money you borrowed.

I would ring them explain that your in the process of starting a DMP with CCCS and that you are not neglecting your account, if you have your CCCS ref No give them that also. Explain you are taking responsibility for the debt and do want to pay it but at this moment in time you are unable to meet the terms set out in initially.
I would also ask for the full postal address as you are going to put this in writing. I have always tried to keep my creditors in the picture as to what is happening and I think they appreciate that rather than ignoring them.
I owuld also contact CCCS in the morning and explain the section about the county court i guess this is an empty threat. As any court would look at what is in place and probably rule in your favour if you have a DMP in place. But speak with CCCS.
Do not worry this is all part of the rollercoaster ride of Debt.

My DMP starts this month with CCCS. What I have established is that your creditors will use some threatening terminology when they write to you or speak to you. At forst it can be quite scary and unsettling, however what does become apparent is that if you stick to the phrase "They cannot get what I have not got". Very few companies take you to court as the cost involved is very high and if you can show a judge that you are making payments albeit not the minimum but a payment and that you have maintained payments the chances are it will be thrown out. Also if it goes to court the judge will want to see the original Credit Agreement.
You will overtime become hardened to the letters and as my wife tells me they are computer generated so try not to worry. Your doing and paying what you can

Have you noticed how its in the first person? I this and I that as if an actual human being has typed this out?
Also the very last line assumes in a guilt inducing way that you are not willing to repay!
I'd be very wary of ringing them unless your 100% sure in yourself ie you know you won't be bamboozleded by the person on the other end trying to trick you into paying more than you can afford.
Email and then write to them(recorded) back quoting all of Mikons advice and say something like " I am paying you back via CCCS, wouldn't it be better all round, cheaper for you, to stop all this nonsense and just accept the payment from CCCS. After all they are going to give it you anyway," Or something along those lines.

Awwww I missed cookies, I was at ballet class watching my little ballerina!, your home school sounds so cool ljm, it must be such hard work well done you for all the commitment you put in, dont think I could do it.
Weather horrible here looking out its like winter outside, quite stormy, although its always windy were I live......not so good for the hair do!
Spoke to barclaycard today on OH behalf had a bit of rant to him about phoning as I'd already spoke to them on Monday he just said o ok and hung up, but have had no more calls rest of day so at least thats an improvment from the hourly ones yesterday!
Have planned to sit down tomorrow and do new budget with DH new wage amount (or lack of wages), done all ironing etc so i have no distractions, am dreading it but needs to be done.
A big well done to everyone everything seems to be going quite well at the minute we are deffo a stronger bunch than before so a big:j:j:jto us all.

Part of my recent letter to a payday loan company as an example (probably end up in court, but I had to have a go back)
Doesn't it make more sense for all concerned that you accept the DMP, you get your money relatively quickly and everybody is happy instead of playing hardball, going to a Debt Collection Agency (who will receive the same response from me) who then may go to court. I doubt if a Judge will look very favourably on your course of action while I am making endeavours to repay my debt. Especially as the amount is so small in my overall debt problem. CCCS will be paying you on the 25th of each month regardless so you may as well accept the DMP, it saves you time and money and you get the same result.
All my other creditors have accepted the DMP, not one has been problematic, not one has refused in fact they have all been more than helpful.
I would suggest you look at the situation again and I urge you to accept the DMP. If not I am more than happy to deal with DEBT COLLECTION AGENCY and will instruct CCCS accordingly.I'm Debt Free :j 2/09/2013

How much do you owe this pack of chancers? Not even polite chancers I might add, who on earth do they think they are talking to, have they not heard of civility and customer service? Obviously not.
Sorry, it costs in the region of £1500 to take someone to court so if you owe less than that, it would be a complete waste of money and the judge would only award your DMP payment anyway. I think this is another attempt to scare you, your email was good and I would await developments from that, remember these numpties get paid on results, they get a commission on the money they collect from you, so they are desparate.

I borrowed £80, had to repay £110(ish) and now it is £275 including charges, interest (30% a day), letter fees, phone call fees, late payment fees, debit card declined fees, fees for breathing, fees for being alive lol.
Yea Im gunna give them a bell tommorow... seee how I get on with them, Ill let y'all know..
Oh... and when they say 'offering you several amicable options...' those options were... Because were SUCH a lovely flexible company with customer service at our heart blah blah blah (get me a bucket) if you pay us £200 now we will take that as a full and final settlement and wipe off over 50% of the late payment charges!

OMG £200 for being 9 days late, its beyond outrageous. How are these companies allowed to be in business should they not be swimming with the other sharks? This is surely another example of a attempt to scare via computer generated email....or mmm which nasty email shall I send today ....it doesn't reflect your situation and your communication with them.
