    I will go away from "them" when I get my money back. Until then Cardif Pinnacle will have me on their back. I may not even win my corner but it will not be for lack of trying and mentioning them on site!!!!!!!!!!

    The 8 weeks started the day they first received an expression of dissatisfaction. This means if you want to go to FOS now then you can do.

    Make sure you state the date you complained on the form and enclose a hard copy of the e-mail

    On the other hand, remember that this will then put you in another queue.

    I suggest you forward a copy of the original e-mail to whoever is dealing with it now and remind them of the date on which it was received and that they have not issued a final response or told you that you can now go to FOS so they are in breach of FSA Rule DISP 1.6.2

    Thanks magpie cottage. They wrote this week to say they would reply within 10 days. I think I will give them the option of getting back before FOS as it was my fault for not writing in a hard copy and i would always advise everyone to send a hard copy of any letter. I may even be surprised....you can only but hope.

    They simply cannot get out of the fact that we were over insured and could never use their policy but its up to them as to whether they are "fair" in this or not. I wonder what sort of a company Cardif Pinnacle really are? I would have always recommended them TBH to people and they seemed to have a good name but after googling complaints about them I am not too sure!!! Time will tell ey!!!

    Just found this document here that mentions over insurance

    Now it says on here
    Monetary Maxima
    The following practices are recommended:
    1. It should be clearly stated that any monetary maximum applies to the aggregate of
    all Income Protection policies (including group policies) effected for the benefit of
    the policyholder with all insurers.
    2. If the insurer wishes to take into account other forms of insurance (e.g. short term
    Personal Accident and Sickness, Critical Illness or Waiver of Premium) the policy
    classes in question should be clearly set out.
    3. Insurers should liaise to achieve a fair and reasonable outcome for policyholders
    who are over-insured in a way that reflects the product design and pricing of the two
    or more products.
    4. It should be made clear whether such maxima are adjusted or are subject to review
    in the light of inflation.

    Maybe this applies to us???

    they are all the same,
    on one of my claims with Lloyds ppi its on the basis i already had my maximum cover in the form of income and mortgage prtection, Lloyds reponse was to say there is no evidence of this,

    problem for them is that the income protection policy is with them, and was taken out in 2001 and is still active.

    robbers the lot of them!!!!!!!

    Still no word off Pinnacle. Now why does that not surprise me?? They said 10 days (AGAIN!!!) and their 10 days is up on 31st May. I bet it will be after bank holiday now. Disgraceful complaints handlings.

    This was an earlier email I received from Cardif Pinnacle regarding being over insured and it said

    Dear ,

    Thank you for your recent e-mail.

    I can confirm that you can claim on two insurance policies if you are not
    over-insuring yourself. According to our personal guidelines we class
    someone as over-insured if the total monthly benefit amount exceeds 60% of
    their gross monthly income.

    However, to allow us to continue to assess your refund, please send us a
    copy of your Policy Terms and Conditions with your other insurers so that
    we can confirm for our records that you have had duplicate Accident and
    Sickness cover.
    (((which we sent to them TWICE) and also firm wrote twice)))

    If you have any further queries, please do not hesitate to contact us.

    Dear

    Thank you for your recent e-mail.

    Thank you for clarifying the situation. I have discussed this with my
    manager, and she has agreed that you have had duplicate cover since 7th
    September 2009 with *************and in March 2001 you had Accident
    and Sickness Cover with *********** Ltd.

    As the companies have changed, we will require copies of your Schedules
    from the different companies covering the period from August 2004 to
    August/September 2009 to show you had continuous cover during this time.
    Please note that we must have confirmation of when the cover ceased with
    each company as proof that it was continuous.

    (which we sent again with all continuous cover!!!)

    I apologise for any inconvenience this may cause, but I am sure you
    understand that we must have documentary evidence to authorise a refund on
    such a level.

    If you have any further queries, please do not hesitate to contact us.
