Hello, back again,
pleased to say I got a refund, although I had to chase paypal to close the dispute over the weekend *rolls eyes*

Apparently as it involved a registered business, they do the same as on ebay and recover the money, then chase the seller if theres none in the account, according to the agents I spoke with.

I highly doubt he left the cash in there so one consolation is that paypal might get the debt collectors onto this numpty:j
