Left my ATM card in the machine and some one stole £200

    Maybe someones trying to find out if this defense is a viable way to make a quick ££ out of the bank??

    The title really says it all and not really too sure if my card was stolen, after I used the ATM and someone memorised my number?

    Or when I finished using the ATM, or after request thing a balance. I left the card in the machine and then simply walked away.

    Then someone came along to see the screen before they used it, would say do you want another transaction they simply hit yes and then withdraw money.

    I used the machine at 3.30 and the transaction took place three minutes after which meant that the card had been in the machine for three minutes before someone came along and took advantage of the situation, there seems to be no time out facility on ATMs which makes this type of theft very easy.

    So very simple question is the bank responsible for the money that was stolen.

    If they use this as an argument when I approached the bank.

    And if they say that it was most likely me what is the best form of defence, Because the police have said that I have been a victim of theft and if so would the bank be responsible for paying back the money taken.:mad:

    I'm sure by the time Easter arrives you'll have perfected the art of a good story without all those leaky holes in it.

    When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.

    Every transaction at an ATM is recorded on CCTV as far as I know , so it's all on record anyway. Talk to your bank!!
  • Seeing as "uniteallaction" isn't coming back for any feedback just yet (or ever) I will keep this general.

    The card would not have been in the ATM for three minutes as the time-out facility would have kicked-in by then, however someone could have quickly changed the PIN if the cardholder had walked away leaving their card in the machine with the original PIN already given.

    The PIN could then be changed, the account emptied and the overdraft maxed out. The cardholder would be liable for all this.

    These types of situations are rarely fraudulent. They are either transactions done by a 3rd party known to the customer (normally teenage children!) and the PIN was common knowledge or a wallet/purse was stolen and the cardholder had kindly left a piece of paper with the PIN written on it. Yes, people do still do that !

    As for CCTV at ATMs, that is unlikely due to the cost involved. I've worked in branches before and our security cameras didn't cover the ATMs and the cameras themselves didn't even run 24/7. In the event of a raid they would have needed to be activated be a member of staff.

    How do you actually know that ?

    Unless you work in the shop or for the bank and know that for a fact, you can't say for definite.

    The cameras might be pointing at the ATM but that doesn't mean they are recording anything.
  • I think what hes saying is that the card was still in the machine (i.e. hes requested a balance on screen then (drunkenly?) wandered off) but the ATM is still on the 'what would you like to do today' menu.

    Someone else has walked up a few minutes later and pressed cash withdrawal, no PIN needed because the ATM is still in the menu for his account. There probably isnt a timeout for that part of the ATM system, obviously there is when its spitting your card out but I guess noone thought a customer would be stupid enough to put his card and his PIN into the ATM then just walk off.

    As for who is liable for it, I can only assume it is you. The bank T&Cs generally state that you wont be liable for any losses which occur unless they are as a result of your negligence.

    You may be able to specify that the withdrawal was done 3 minutes after the balance enquiry (as both are time stamped on the ATM logs) but as for getting the money back, I suspect its unlikely.

    Think of it as an expensive lesson.
