Left my ATM card in the machine and some one stole £200

The title really says it all and not really too sure if my card was stolen, after I used the ATM and someone memorised my number?

Or when I finished using the ATM, or after request thing a balance. I left the card in the machine and then simply walked away.

Then someone came along to see the screen before they used it, would say do you want another transaction they simply hit yes and then withdraw money.

I used the machine at 3.30 and the transaction took place three minutes after which meant that the card had been in the machine for three minutes before someone came along and took advantage of the situation, there seems to be no time out facility on ATMs which makes this type of theft very easy.

So very simple question is the bank responsible for the money that was stolen.

If they use this as an argument when I approached the bank.

And if they say that it was most likely me what is the best form of defence, Because the police have said that I have been a victim of theft and if so would the bank be responsible for paying back the money taken.:mad:

    if it was three minutes then there would be no way they could have accessed your funds with out knowing your pin number and they do have a time out on there

    No the bank isn't reponsible for your negligence. Anyway those cameras they fit to ATMs would have filmed you taking the money anyway.

    As jamespir has said, there is a time out on all cash machines, there is also an audible bleep whivh should alert you to the fact that your card or money is still in the machine.
    Your card comes out first, if you don't take your card the machine will retain your card, therefore no money will come out.
    Me thinks you have lost the money in some way and trying to pull a fast one and see if it is possible to claim the bank.
    If I am wrong I apologise in advance for any embarrassment caused.

    Credit card and overdraft at 18. 2 loans and 3 storecards at 20. University education flushed down the toilet through debt at 22. Car finance at 23. Car repossessed at 24. Rock bottom at 25. Learnt my lesson 26-33. Now 34 with a mortgage on an affordable house, a car paid for with cash and a bank account in credit. I learnt the hard way.

    The card would have not sat in that machine for 3 minutes, they get 'sucked' back in after about 30 seconds and put in the card bin. Unlikely that someone guessed the PIN within 3 attempts.
    These are my thoughts and no one else's, so like any public forum advice - check it out before entering into contracts or spending your hard earned cash!

    I don't know everything, however I do try to point people in the right direction but at the end of the day you can only ever help yourself!

    If you haven't yet reported this to your bank, then you are creating the possibility of further losses on your card.

    ATMs do have a time out facility after which the card is swallowed. If somebody stepped in and checked a balance etc after you walked away though, they could have used other ATM facilities in those 3 minutes.
    So very simple question is the bank responsible for the money that was stolen.
    The bank should argue that you have been negligent and tell you to do one. You will need to argue back that the Consumer Credit Act gives you protection and they will, after a battle, have to back down and reimburse. Unless they can show that you actually took the cash. They will, no doubt, check the CCTV to confirm what happened.
    And if they say that it was most likely me what is the best form of defence, Because the police have said that I have been a victim of theft and if so would the bank be responsible for paying back the money taken.
    If I leave my front door open and my plasma TV gets pinched I am a victim of theft caused by my own stupidity.

    Seriously?

    How do you it was 3.30 exactly that you visisted the machine and 3.33 exactly that the cash was withdrawn? You rememeber to note the exact time of visisting the machine, but didn't notice you had left your card in it.

    Not sure if all machines are the same, but I think you have to take your card out before you get the cash? If the card isn't removed, it gets pulled back in and the cash isn't vended. Having said that, I stood behind a young chap at an HSBC atm once and he was on his phone, during an excitable conversation he walked off without taking is card or his cash - I am pleased to say I spotted this and shouted him back. He did look particularily sheepish. Bless.
