beverley1296 wrote: »I too sell all my old mobiles at car boots and never remove old sims, it is a very scary thing, having heard this young mans story, unfortunately he had a bad defence lawyer, who did nothing to help him and he has now been convicted, although the trial judge must have known there was mistakes made as his sentence was minimal, almost a slap on the wrist. He now has to get an appeal solicitor, and the only way he can clear his name is to find new evidence, the only evidence to prove his claim comes from Virgin mobiles who are washing their hands of it, possibly incase they get sued. so if we can find out for sure that these records are kept then we would find a judge to make them pass on this evidence.
The whole case was circumstantial, and the lawyer he appointed is big friends with CPS and police, like anyone who has never been in trouble with the police, how do you know who is a good defence lawyer and one who is not??
Oh... that's not good. Conviction = guilty (officially), so no chance of suing the newspaper, I guess.
I'm not exactly au fait with the legal process, but if the judge knew that "mistakes had been made", surely it was his/her responsibility to highlight them and ignore (or instruct the jury to ignore) the unsafe/dodgy evidence.
I would be extremely concerned if a judge gave a lenient sentence to reflect the fact that they thought the defendent might not have committed the alleged offence.
You say that the only way to appeal is "to find new evidence". If the judgement was unsafe (because of "mistakes being made" but not previously considered), surely revealing the previous mistakes would constitute new evidence. If this was me, I would definitely find a good appeals lawyer pronto!0 -
Could someone explain why anyone would "Buy" a SIM, when you can get them "Free", you would still have to register it or if its PAYG, Top it up?0

I used to flog free sims too. You would be surprised what people will pay for.
I used to get bundles of O2 sims sent free. They came with free £10 credit once you activated it and topped it up with something.
Another benefit was that O2 used to send them with sequencial phone numbers so you could have "His & Hers" mobile phone numbers.
It is amazing what people will throw money at, like the Air Guitar which was auctioned on fleabay too (and 100m of WLAN wire).0 -

The problem from the beginning was he sued his first lawyer and won, consequently no other lawyer would touch him, and as he has no access to internet, and as he is a rather antiquated person he had no idea of the problems that laid ahead. He believed in Justice.....................
I have now found him an appeals lawyer in Manchester that has took him on, but it's gonna take ages and all the time while this poor lad is living a nightmare, unless you read the papers he has and sat and thoroughly listened to the whole episode you would not believe it.... the law is an !!!,
but we have just found a reporter that is willing to take up his cause as well, so hopefully before long this should all be made public, as none of us will stop til this man clears his name, I can assure you that he has not done anything wrong, but his solicitor barrister CPS and police have!.... I know quite a bit about the law, through being the victim of a murder (losing my only brother) and I know how the truth does not come out in court, we as victims had no recourse, although I tried, but as this young man is still alive, he has..... as I know (dead men can't talk) good job this one can!!!!
This all needs highlighting as this could happen to anyone..........................
cheers x0 -
beverley1296, have you ever considered that it could be you that has been lied to?
If this story has been in the papers, why not give us a link?Gone ... or have I?0 -
I have considered everything, his appeal lawyer knows he is not lying, the solicitor and barrister he chose to take on the case, - as quoted by another solicitor - were the worst he could have chosen as the solicitor is training to be a CPS lawyer, so was not out to defend him, we are in the process of making a solicitor and bar council complaint, you would have to meet him and read through all the evidence to understand this, its disgraceful. I will inform you when he has it overturned.0

UPDATE We have now found an appeal lawyer who is taking on his case, as his Barrister who got him the convivtion told him he had no right of appeal...
How wrong was he???0
