  • Surely though they must have archived details, specially when people have put money onto the phone, of where and when this was done? Also they wrote saying they had no records of the phone but they could tell him weeks after he rang to report his phone lost, they received a call asking for MMS and WAP to be activated....this proves to me they DO have records, he lost it in 2006 and this letter is dated 2008?
  • For some reason Virgin are being very unhelpful, we have just wrote demanding all details from them or we will pursue them through the courts and ask a judge to make them prroduce the relevant information.
  • They do have records of conversations between the account holder and Virgin but they don't have access to call/top up history any further back than 3 months.

    Bringing up an old post now but if anyone wants to buy very cheap sim cards contact me craig.wright@dreamsolution.co.uk sim cards in there retail packagin brand new and unused for just 20p a sim

    Thats what they keep saying but surely someone would have this info, such as their credit controllers, they must know where top ups were bought from and on what dates? as they would have to keep records for the auditors?
    We don't mind having to pay for the information, but we need it as this would be the only was this lad can prove no way did he send the filthy texts, the mobile phone masts where texts and images get sent from must also know what network and numbers used there mast to send info? but how we would get that I have not a clue.

    Of course it's not OK to post that. However, maybe no-one reported it ? Did you ? The people that give up their free time to help run this place can't read every post and rely on things being reported.

    A neighbour of mine has been fighting to prove his innocence for 3 years over a sim card...he has been called a !!!!!phile by the local newspaper...

    I can't imagine how distressing this must be for him, and he would obviously want to clear his name as swiftly as possible. But since the law considers you innocent until proven guilty (either beyond reasonable doubt or on the balance of probabilities), the onus really should be on the police/newspapers to prove his guilt rather than the other way around.

    If I was in this situation I would take legal advice with the intention of suing the newspaper for libel.

    You've got me worried now - I gave away a SIM card when I sold my phone a while ago... :(

    I too sell all my old mobiles at car boots and never remove old sims, it is a very scary thing, having heard this young mans story, unfortunately he had a bad defence lawyer, who did nothing to help him and he has now been convicted, although the trial judge must have known there was mistakes made as his sentence was minimal, almost a slap on the wrist. He now has to get an appeal solicitor, and the only way he can clear his name is to find new evidence, the only evidence to prove his claim comes from Virgin mobiles who are washing their hands of it, possibly incase they get sued. so if we can find out for sure that these records are kept then we would find a judge to make them pass on this evidence.
    The whole case was circumstantial, and the lawyer he appointed is big friends with CPS and police, like anyone who has never been in trouble with the police, how do you know who is a good defence lawyer and one who is not??
