    My hubby has just gone onto ESA as his sick pay ran out from work he has submitted an ESA50 form and awaiting to go for a medical.

    He's also been asked to go for an interview about getting back to work which is silly as technically he's still employed as they can't sack him and he works in a factory on a shop floor so they can exactly modify stuff in there to take his wheel chair.

    All this is such a minefield and it's confusing

  • We are in the same boat as you cutesmile... my husbands sick pay has run out and he is on ESA. goes for a medical next week and after reading everything on here we are expecting them to pass him fit for work even though his own doctor and consultant say not.. he is still employed so what happens if the ESA doctor says you are fit for work but your own doctor and the works doctor say no?

    brendang, it has just been confirmed on the Benefits board that the ESA transition has definitely not started, so it looks like you have been called in error. I would contact the JCP to ask why you have been called. I think they have made a mistake.

    My hubby had a call today to make the appointment for next Monday and the woman told him not to worry about it, but that's ok for her to say. We sent off the limited capability for work questionnaire off the other day after we had help to fill it in and some of it were similar questions to what he was asked on the dla form.

    He got a letter about a medical by ATOS for DLA even though they'd already got the form and another form from our GP.

    Just don't know whether we're coming or going and it makes you feel like you're making it up.

    Hubby was my carer but strewth I'm having to care for him and just finding it so hard that its wearing me down and my mental health is deteriating even more then normal.

    Sorry I'm whittering on.

  • we had a letter delivered this morning with an interview at the job centre called pathways to work. the interview is for my husband who is on esa because his sick pay at work has run out... what is a pathways to work interview for if you already have a full time job but are signed off sick???

    Legally AFAIK if you're receiving ESA the job centre is obliged to carry out a pathways to work interview - they can defer but not waive it. If you haven't had the medical assessment give them a ring and let them know as they are supposed to have the info from the appointment to help them help you (my fingers and brain are all tied in knots, hope that makes sense)

    I'm caught up in this system too. The pathways to work interviews are just a formality, the government has decreed that they will get the sick back to work so they have to run these interviews and they are at set intervals. I am too ill to work and still under contract from my current job so can't look for other work if I was well enough to do it. However I have to attend these interviews. The people running them apologise for the bad timing but they are tied by red tape.
    The joke is by the time I am ready to look around for alternative work the 'course' will have finished and then the help won't be available !
    So far my 'action plan' has involved looking at a voluntary work website in preperation for when I am free to do other things and to go for walks to improve my health !!!
    The biggest hurdle is the medical , so hard and depressing to stress what you cannot do any more but has to be done ! I was lucky and managed to pass but many don't from what I have read!
