Sorry I have not posted on this thread much today, had some catching up helping on the PPI threads.
Its a very humid night though.
This hay fever is a damn nuisance, and sorry to everyone else who suffers this as well, I have a nasal machine now, which helps, and with also being asthmatic its been a nightmare.

Hi MouseAnn - I used to work for an insurance company check the small print if it doesn't specifically say they will refund to your M&S card I would write to them and insist on a cheque, they should not know anything about your circumstances - as insurers they should only have access to info relevant to you as an insurance risk/insurance customer - but I have never worked at M&S.Fitzer2000 wrote: »Hi Ann, I'd do what Chatty says. Nothing to hassle Niddy with (at least for today!) just a couple of reminders from CCs.
Plus, I have received an answer re my letter of complaint to the insurance company (M&S) re my complaint that the excess was trebled and I didn't think I had been given adequate notice! The letter was very long but they agreed, as a "goodwill gesture", to refund £200 of the excess I paid on my recent repair, which takes it back to the original excess of £100. HOWEVER, this is not a result for me! They go on to say that the amount of £200 has been refunded to my M&S Mastercard, which I used to pay my premium last year. I am sure you can all visualise the state of my M&S Mastercard - which means that I am going to see absolutely nothing of that £200! It did make me wonder whether M&S insurance knew this!
Oh well, I suppose I can call it a "hollow victory"!

The way refunds work with all products is that they must refund to the original card or method of payment at the time the policy was paid for. So lets assume that you paid with Direct Debit, they refund to your bank, if you pay using debit card, they refund to the same debit card and if you pay using your M&S card they will refund to your M&S card.
No laws that make them refund by cheque i'm afraid..... however you should refuse this (blag it) and tell them that you want the funds refunded to you, because you no longer use the payment card that was used at the time you took out the policy - they may well do it, even try ringing them and asking.

There is no breach to DPA within the same organisation, ergo Ann took out insurance and would have left the option there about being informed by the "GROUPS" other products and services, similarly, the same on her M&S card resulting in signed authority to share data within their "Group".
Group being the operative word here......
The DPA doesn't really hold much leeway to be fair, too many people presume that they (the ICO) can "sort out problems" - they cannot. All they can really do is to advise the company of their breaches and advise them as to the next steps - unlike the FOS/FSA the ICO have no powers to fine so really its a wasted journey and lenders do realise this.....

Just to clear up Locke & Fitzer are both from my UE thread yes, and both are sound..... I think Locke is a bloke but now you have me wondering, i've never thought to ask why they have Locke (from Lost) as their avatar - unless they look like him or fancy him maybe? Mornin NID and All. It was a joke a mate told me in the pub a while ago. He came in all flustered and said "He's broken his arm in two places". "Who" I said, " He also broke both of his ankles" he said ignoring me," WHO" I said again a little louder. He continued to ignore me " he'll be in hospital for at least 6 weeks". "WHO" I shouted.
