    However if they are unenforceable now, they will remain so. You need to have a thick skin - i.e. you'll get letters and hassle on the phone, but so what? You'll be stress free.... Plus i'll be here telling you what to do...

    I've got a thick skin and an answerphone :D Just so long as I don't get any callers at the door.

    Cash withdrawals, i.e. withdraw a few hundred to ensure you have the £300 per month repayments for the lloyds card! Or it could then be classfied as deception, i.e. our moral dilemma earlier ;)

    I have loose morals!!!! (but don't want to get 'done' for deception!!)

    Yea, you're reading this right - i'm saying withdraw like £300 per day for 5 days in a row from your lloyds card, then use the funds to pay the min payment to the card when it becomes due - this buys you time. Its called taking from peter to pay, ermmm peter haha

    I've used cc cheques before to put in my current account to pay my credit card :D

    This deception thing is a bone of contention alright - it is really down to your own morals and beliefs - we can easily prove to a judge that you intended on repaying the Lloyds card, i.e. you want to - who knows, in 5 months time you may find work and repay it - that is better that having 8 cards with various apr's that bog you down..... :D:D

    There is no personal gain, as such, to you as you're only moving your own available funds around your own accounts - the ones you're attempting to get made unenforceable are as is, i'm not suggesting you spend on them then go and apply for a s.78. So deception/fraud really doesn't come into this....

    That, would stand in court from someone with no intention of defrauding anybody! :o

    Fermi, you know I respect your decision but it's never going to go to court mate.

    I've read quite a few cases now that "should never have gone to court" and quite a few decisions made by judges that "should never have been made".

    I may pop in later, but if not i'll be here at 5am ish and will reply then.... but you should think about this, at the end of the day it is better than bankruptcy and also leaves you in complete control, i'm sure Ann will tell you the truth - yea it is daunting, but deep down you remain in control at all times - you hold the ace card - NOT them.

    Me too - thanks to your PM's. However, you know what i'm saying - different if we're sitting here taking the mickey by spending galore then doing a bunk (renegade debt) - i'm against that myself, this is entirely different in that we're looking to manage her debts all in one basket so to speak, therefore make one simple monthly repayment.

    If she gets a job she can then repay the debt, if she doesn't then no harm in utilising her right under the CCA, is there? ;);)

    We're assuming before any of this that the Lloyds card will be unenforceable, if it is not then Pixie will have to arrange prepayments anyway - but repaying £15k is better than b/r and more manageable as well. :D

    Nooo -fermi knows his stuff, this is the same discussion we had earlier.... he is entitled to his opinion - only you know what path to follow, as I advised. However you can see my counter argument on my last few posts which is what you would say - as it is the truth! :D:D

    You're not out to defraud anyone, so nothing to worry about.
