    I'm thinking of telling JCP before I leave the relationship so that hopefully what ever they decide to do, it can be resolved before I leave.

    My partner is becoming suspicious something is happening, especially after I saw my therapist a few days ago who said her infidelity will probably carry on. I am worried about leaving and now this with JCP.

    Do you think if I tell them I have had rent which is the same amount as the mortgage (this is the truth), they will not see it as additional income. Will they stop benefits all together or even prosecute. I'm going to tell them, rather than them finding out - they might be a bit more understanding. It's only been happening 5 months.
    I’m hoping that after they have investigated, I can get on, leave and move to my house.

    I can't think how your second property (as a couple) would be treated for SMI purposes. If nobody answers in the meantime I'm sure I'll have remembered by tomorrow.

    As the situation has been occurring for such a short time, it would be unlikely that they would prosecute. It is more likely that you will have to pay a penalty. There is more information here on what happens in fraud cases.

    Try not to worry tonight, there is nothing you can do until Monday.

    Hopefully they will have a nice room in a prison for you so that you can leave your wife. Rent free too. I hope you sleep well knowing that many people cannot afford a house yet are made pay tax so that fraudsters like you can get a free ride.

    Beleive me I know I made a mistakes at the time. I was made redudant after working all my life, then within 2 weeks my mother died, I lost my job and my partner cheated on me with a family member. When I made the claim, I was in another world with perscription drugs as I had a break down, which only now I am getting though with intense therapy.

    I messed up I know, but I want to rewsolve this and pay what ever I have to.

    I have always been honest and hard working so please don't judge until you have been through what I have.

    I agree, leave the banter out of this thread, the OP knows he has done wrong, and is going to correct it, he has had a difficult time and a little compassion from some of the other peeps wouldn't go amiss.

    Confusedandconfused, nothing much will happen once you explain, a fine at the very most and probably a suspension in benefits for a wee while whilst they investigate - stop worrying.

    I hope your therapy is helping you through the difficult times, you've had alot to deal with in recent months, I wish you the best.

    Its funny how when people are 'muddled' they always come out with money going to them - they never manage to get in a situation where they claiming too little.

    As it happens there is another thread on this board right now where a couple has lost money due to the husband taking over their tax credit claim while his wife was ill.

    I know exactly what you mean though - it's normally the other way round.

    Makes me wonder how people manage to even claim anything but the main benefits when they are in such a state...

    Hope you get it sorted though OP - you are doing the right thing.
