Thanks DancingFairy - i'm still waiting to hear whether she has returned the judgement letter to the court unopened, still no news. Then I will know whether I should go to the court with her new address. With any luck, IF she didn't move, she will see sense and just sort this.
Needless to say, with the recent news about my job, that money will no longer be a 'luxury' if we win it (or win any part of it) - it will be invested into the new business, or be used for bills if I can't get things off the ground.MFW #185

Still no news from the court (ie: no notice from them to say that she has returned the notice letter) - will call them tomorrow and ask what the latest news is... Would be nice to know at least if she has had it or not.MFW #185

I read all the thread this week-end (ended-up being 2hours late for a party because I just couldn't stop!). When I started reading, considering that it all started in July, I was quite sure that I would be able to know the end of the story ... So there I was reading messages 1by1, when I realised that it was august, then september, then october, then november ... couldn' t believe it.
Now I saved this link so that I can access it at all time - GO EegerLearner !!!! I'm so glad that there are so many people around this forum to help/support.
I'm moving flat soon and I feel like I might have trouble over my deposit which is why I ended up on this forum - looking for some info to be prepared in advance. I have a couple of questions and instead of starting a thread if anybody here has an opinion/idea etc... Please let me know:
1) - I said to LL that we might be able to leave earlier than planned (ie a few days before the end of the month which I thought would be helpful as it seems LL wants to do works - decoration kind of things and we don't want to have any while we are still in)
- in reply LL said it is fine if we want to move earlier and asked us to pay for our full month and "monthly premium"
so I'm ok with paying the full, which is done already anyway and I was not planning to ask for money back if we leave 2 days earlier!
But what do you think is this stuff about monthly premium ???
I read about what is a premium and I can't see what this has to do here!
Other tenant moves in on the 2nd – does he plan to ask us to pay for the 1st ? Lease started on the 30th so ...
2) we don't have an inventory ... we were not worried LL seemed to be "cool" etc.
And we didn't break anything in the flat etc... so I guess there is nothing he can really do or has to prove that it's our fault ?
Nothing is mention in the lease about when/how the deposit will be given back
and I read the Housing (scotland) act 1988; nothing there either
My plan is to: take pictures, get in writing from him when exactly we get deposit back if he does not want to give it immediately. He cannot decide to keep it 1month if we disagree? It is not mention in the lease either that he can keep it until proof that we paid all remaining bills and bcse it is not in the assured tenancy act (mentioned above) he actually can't use this as an excuse to keep deposit longer ? (and try to invent excuses not to give it back – already just mentioned the carpet was new when we moved in which is an absolute lie but we’ll get a carpet cleaner anyway, we are just too nice)
Do you agree that if we move one day earlier or something like that bcse he wants to do works it would be our right to get the reading of gas/electricity done?
Thanks for any help and sorry for too long post - I must say it feels good to be able to write things down though.

Hi Zebulon, thanks for your support and for staying with me! My advice on your situation would be that you get photos of everything after you have cleaned the place, get the landlord to sign something stating when the deposit will be returned and also to explain exactly what a 'monthly premium' is and how much it will cost you - I have never heard of such a thing but maybe it is legal so whatever the amount is could be due.
No matter how 'cool' he seemed, I have learned my lesson - having things in writing and pictures doesn't hurt and backs you up.

UPDATE 21/11/06
Hi everyone,
Last night I came home to a notice from the court saying we have a court date set - 13th December, 3 days before we leave on holiday!
It doesn't clarify whether she will be there or it's just us and the letting agent. The only query we have with the LA is that they returned our deposit to the landlady even knowing it was still in dispute by us.
Anyway I will call the court today and ask whether the landlady will be attending or it is just the LA, plus have they had any response from the landlady.
Still not sure whether I should give the court her new address as I still can't tell is she has actually moved - can any of my previous helpers check to see where her bills are at now as some time has passed:beer: - any clue is better than no clue! :T
