pru - does the loser have to get the winners written permission to avoid a CCJ even if they pay up within the time limit set by the judge ? i cannot see how that works as surely monies are paid into the court first who then send it on to the winner ?

You just need to ask the court and show proof of payment. A cheque will do or a receipt from the winner. I think there is a small fee. In EL's case, it was paid there and then and the judge didn't even enter the judgement on the register.

There probably isn't much incentive for the winner to write a letter, especially if they are still angry.

Clutton - you need to ask the defendants for copies of the witness statements plus names and addresses of the witnesses.

RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

although im disappointed that you didnt get more back (as i feel you deserved more than you, not only on account of the deductions being unfair in the first place but on account of the runaround and hassle of it all) i wanted to say a big congratualtions for believing in your rights and standing up for yourself when a lot of others would have let it slide.

if nothing else, here's hoping that the evil LL has learnt a lesson, and will treat future tenants appropriately and fairly :T

have you thought about selling your story now that it is concluded, and you can encourage other people out there to fight for their rights?

Just realised that I've missed several months of this thread, having been in on the odyssey when it was fresh at MSE - sorry!

Well done EL - to get anything back out of blighters like this who know every trick in the book to play the system is a major victory for the little (and honest) guy!

Well the £50 a month is prob with the vantage account, it's just a question of which trust we choose I s'pose - for £50 a month you can only choose 1 trust I think.

Well I depress myself weekly trying to figure out my shortfall for buying a new gaff - I knocked up a spreadsheet when I was v bored on a conference call that calculates my interest only payments for the BTL piece of my master plan... and I have been v conservative in terms of the potential letting income so will literally be down to £50 a month myself allowing the flat to just be able to wash its face...

Pity ex and I keep missing each other in various company locations... he's Mister Intergalactic traveller and I seem to be city-bound...

Well, it's about time! HUGE, HUGE congratulations EL. The relief must be wonderful.

Seems we are all slightly disappointed with the amount, but this is a massive moral victory above all else and - from an observers POV - it certainly seemed the money became secondary to the principle - i.e. not letting the slimy witch get away!

Whatever you do with the money, enjoy every penny and know that she will be cursing the day she decided to try and rip you off

I need a new saga to follow! ;)
