Thanks guys - have just checked RM site and package still not collected - I guess if she does not collect it up until Tuesday it will be sent back to us.
My fear is that she knew she was going to do this, and by putting a c/o address on file we cannot get bailiffs in or anything else as we won't know where she really lives.
I think it's doubtful she will collect. If not, what use will that do us in court if she doesn't turn up and we win by default, but can't find her...
Anyway, will worry about all that next week. It's the weekend!MFW #185

I think this is a real possibility, if it happens I suggest you refuse to leave the court till the judge has told you what your options are to collect the money from a landlord who's pretended to have gone away again. Perhaps you can put a charge on the property. If she has done another runner make sure the judge knows what happened last time and maybe he can punish her somehow, contempt of court ?! Make sure the judge knows the current address is the one the landlady told you to use IN COURT LAST TIME and that the previous judge agreed to the use of that address.
Also once the package is sent back to you take it into the court straightaway and ask the clerk for advice what to do next. Maybe they will know how to deal with it. At least get on record what has happened and that you are trying to sent the package to the landlady.

i advise that you ask the court to send the package to her - if the package is refused from the court - i suspect a judge will see this as much more serious than if it is refused from your address. All court envelopes have the court address on the outside and she will know what she is refusing - this has to be contempt.0

Hi guys,
Bad hangover today so excuse short message (don't deserve pity though...) - just realised yesterday that a Special Delivery package can stay at the depot for 3 weeks before getting returned to sender so we prob wouldn't get it back before the court date.
We would def mention in court that she gave that c/o address to the last judge.
We would not be able to give a copy of it to the court now to post to her as we have gone past the 2 week prior to court date deadline?MFW #185

Well its her own fault if she doesnt pick up the parcel. At least you have the proof that it hasnt been received. Take a photocopy of the slip and also a print out showing that it hasnt been picked up etc.
