She's got no intention of picking it up. she's going to turn up at court & say she never got it. In the hope of stalling this further.
"Mrs. Pench, you've won the car contest, would you like a triumph spitfire or 3000 in cash?" He smiled.
Mrs. Pench took the money. "What will you do with it all? Not that it's any of my business," he giggled.
"I think I'll become an alcoholic," said Betty.

We posted it on 11th, Royal Mail tried to deliver on 15th May. I just want to understand how can she use the fact that she hasn't collected it to delay things?

I'm not saying she'll have any success, I'm just suggesting that will be her next tactic.

"But M'Lud I never received these documents"
    EL shows proof of posting

"But M'Lud they must have been sent to the wrong address"
EL shows address given by LL to the court & on proof of posting

"But M'Lud I couldn't make it to the post office in three weeks, because I was constantly visiting my poor daughter in [STRIKE]the Maldives[/STRIKE] hospital, & being [STRIKE]such an evil old witch[/STRIKE] so dedicated to my daughter, I don't have any friends to pick it up for me"

Just what I would do if I was your evil ex-LL.

She'll say she never received the card and therefore how could she pick it up.

You just  that someone could besmirch the Royal Mail and show proof of posting ....... then point to prior correspondence the LL had with you about the dispute and that she stopped corresponding.

Take another copy of your documnets with you

Worst case: the judge postpones but you make sure she puts a servicable address on record to the court.

I thought you sent it special delivery. Shouldn't they have tried to deliver it on the 12th? Or did you post it on the 14th?

I wouldn't worry, you have proof you sent it as required to by the court. She can try to say she hadn't received it (or received the card) but I hope the judge wouldn't delay the case for that reason given her history of things "not being received".

Has she provided you with any documentory evidence? if not she can't use it in court.
