    Speed reader - my thoughts exactly! It took me most of a rainy Sunday afternoon and into early evening. I was so enthralled, hubby had to keep bringing my cuppa to the computer and I resented having to stop to answer the phone. Never mind Nuremberg or Saddam Hussein - this upcoming court case will probably have more people hanging on the outcome than any major trial of the past fifty years!

    That's irrelevant for YOUR purposes ... IF Evil-LL disputes your sending the documents OR argues that she "should" be allowed to ignore them as she "never got them" ---> That OPENS the door for your to produce your Agreement to prove that "The Documents WERE provided In Accordance with the Tenancy Agreement Requirements".

    Hiya Gold Shogun, thing is we have already submitted out bundle so cannot now add to it. Plus I am hoping the judge will see through her - here's to hoping - all we can say is we posted it Special Delivery and here's the receipt to prove it, and by the way she never accepted any of the 3 letters we previously sent to the other address because they had our name on it (shows the judge the returned envelopes etc) and yet on a later e-mail confirmed she had received a letter forwarded from that other address, showing she did receive documents from there after all and was being selective.

    Can anyone who is a landlord, pretend for a moment that they are Evil, and give me ideas as to what excuses she may bring up, so we can work on answers? 'Blue sky it' please people & enjoy the character change :D

    I am utterly amazed at your determination to persue this women through the courts, I would have been frightened off long ago and I sincerely hope that you get the money that is rightfully owing to you. I salute you and your husband, and I hope that all of the advice given on this thread helps other people stand up for their rights and not let unscrupulous landlords effectively steal money from their tenants.

    I will keep my fingers crossed for May 31st, and check back for an update.

    Hi EL - one worse case scenario could be that she does not turn up - and has sent some lying excuse to the court re a sick relative - and has asked for an adjournment. What will you say if she has done this ?

    Or she could simply not turn up at all and you get a judgement by default.

    Another could be that she paints you as a dirty tenant who left the house in a disgusting state of squalor and that she could have charged you a lot more - or taken you to court but that she wants to move on.

    She could try to paint you as the tenant from hell - noisy parties, filthy habits, drug-user, was always late with the rent etc etc - How will you refute these lies ?

    (Did you include any bank statements to show you were a good rent payer ? No harm in having them at the back of your file in court.)

    Bearing in mind what i have experienced in my court case - a TOTALLY unexpected ploy - - let's see what other MSEer think is the witch's worst case scenario.

    Also forgot to say I had a nightmare involving her last night, just remember being in a room with her and she then sat down at a table next to me and tried to place something flat over my mouth and it had lots of superglue on it. I managed to take it off before the glue set but it was so vivid I woke up this morning and couldn't sleep in. Spent the morning filing business stuff and placing online ads, so time well spent I suppose.

    EL ... Kindly "forget" about what papers you have or haven't already "included in your bundle" --> I can tell you from long experience that Civil Magistrates are VERY RARELY so inflexible as to disallow "Refuting Evidence" in respect of disproving an opposing witness statement.
    I am a Landlord & I have represented myself & others in Court on numerous occasions ... All I ask is that you place a little trust (at no risk to you) in the advice I gave ---> Namely, HIGHLIGHT the relevant "notification clause" in a copy of your Agreement AND staple your your Rec.Del. Receipt to it, and hand BOTH to the Bench to prove you despatched the documents as required ...

    I am 99.8% confident that the Bench won't bat an eyelid & will take the "two parts" as "a single inter-related whole", and even IF the Bench refuses to look at the highlighted clause, you would be NO worse of than if you had never bothered to try.
