i dont think you can produce evidence at the last minute like that ......
It's not evidence.
It's EL's response to the landlady's argument.
Example:
Washing Machine pencil Mark - £10 - Cleaning - Washing Machine had a pencil mark when Claimants moved in - see original inventory section 3.
The landlady has documents (her evidence) claiming cleaning the washing machine was £10.
EL argument is that the original inventory shows that it was there when the claimants moved in. The evidence is the original inventory.I'm not cynical I'm realistic
(If a link I give opens pop ups I won't know I don't use windows)0 -
what i meant was i think you have to produce your evidence/whatever you want to call it before the hearing with copies for all, and not just produce something new in court on the day when the other party has not had time to look at it and consider it.0

I agree with both Clutton and Olly300. You need to provide all evidence prior to the case, but I don't think you need to include your counter arguments. (but have them all worked out and written down for your benefit.)
Then for each item on her counter claim you go "please can I refer you to appendix c document 7 page 3 (or whatever) - The check in inventory clearly shows that the pencil mark was already on the washing machine when we moved in."
or do you need to provide a defence to her counter claim? If so I suppose you have to include this before hand.
Good luck0 -
I spent one long winter afternoon reading this entire thread! I know that the court case is sometime in May. Can somebody quickly put me out of my misery and tell me when the hearing is scheduled? I don't have time to re-read the whole thing but I do want to know what date to pencil in on my calendar!0

:T :T :T :T"Mrs. Pench, you've won the car contest, would you like a triumph spitfire or 3000 in cash?" He smiled.
Mrs. Pench took the money. "What will you do with it all? Not that it's any of my business," he giggled.

Hi all,
Thanks for your comments and support - I can tell you that yesterday a client helped me out a great deal - only found out she was a court clerk recently! Thankk GOD I took her up on her offer for help.
We worked on it from 13:30 to 22:30 - that's 9 hours people, of solid picking at the meat to expose the bones, then putting all th emeat back and then some.

I learnt so much - landlady is going to fall off her perch when she sees how much factual and dated info there is on there.
Tonight we are polishing it off to prepare to send tomorrow. I will post her copy tomorrow via Recorded Delivery and then personally drop in the copy to the court on Monday.
May call the court today to double check her current address on file in case she is being sneaky.
Our statement in the document we are sending does include our thoughts on carpet, radiator cover etc and the fact that many aspects were included on inventory. I am not really afraid of submittin gthat now, she can't dispute that the inventory showed 75% of the 'damages' she later deducted us for.
Catch up later folks - PS: have had countdown in sig for the last week to help everyone track when the court date is - 31st May everyone - diaries at the ready!MFW #185

For something so important, I'd use special delivery instead: you'll have full tracking of the item.0 -
