    :D Very nice weekend thanks all :D

    Mini-bar in room, champagne at the breakfast buffet as well as prosciutto ham, peach halves and chocolate croissants are things I have never had in hotels before - shows what 4* can offer - the fact I didn't pay for it helps too, thanks to MSE and the Easijet Hotel double your money back offer!

    We saw Milan, Bergamo and Lake Como - lots of wine and lots of sun too, nice to relax ;)

    Of course in the back of my mind though was coming back to, ugh, court case...

    Tomorrow/Thurs have to get inventory for current property done as current landlady is being very patient.

    Then Fri/Sat morning we need to somehow get all paperwork together and submit all details. I think we still have most of it from last court appearance so shouldn't be toooooo bad...:o

    Hi everyone - we have now posted the inventory off for current property and also received the Deposit Protection Scheme confirmation - what a breath of fresh air this landlady is.

    Re the other landlady, am setting aside this weekend for looking through it all. We should technically have everything we need as for the January court appearance we took all the docs we thought we needed but they were not required at the time.

    So I think a review of those docs, plus adding one or two more bits, should suffice. Hopefully it's not as scary as my mind is making me think it is!

    Should we write a letter to go with it? The main thing I think is worth pointing out to the court is that the court case is based on the deposit deduction made in August and importantly on the invoices/receipts received in August, NOT the ones she submitted in January which varied from the originals.

    What did your original claim state? If your original claim wasn't clear then add a page titled "index" at the front of your document bundle, put the brief statement at the top of it (2-3 lines) and then list the documents you have enclosed in date order.

    Also please put in a copy of your handwritten inventory from August 2004 even if it is hard to read. You don't want to look like you are hiding documents as your ex-landlady is trying hard to confuse the court.

    I agree completely with Guy. I would always err on the side of having everything there and submissable than be kicking myself that I hadn't included something and then realising it could have made a difference.

    Yes, this is good advice. Another point: if evil LL is faced with a mountain of paper to read, she will have to spend more time and effort preparing her response and is more likely to make mistakes, overlook something important, etc. No need to make life easy for her!

    However, for the actual court hearing you have to be very clear which douments are important, and guide the judge through what they are and why they matter.

    Hi EL, I like the idea of a short summary to remind the court (& the evil LL) why you're there, they can always ignore it. Also I like Olly's idea of providing a index of everything you are submitting.

    Was wondering how things were going - coudn't find the thread. Remember following this around the time of my last set of exams before Christmas and hoping for a resolution then. May- more exams - last ones though - hope it's the end of a long road for you and you get your money back and show everyone what a thoroughly nasty person the landlady was.
    P.S What do you think landlady will try to do this time - it helps to be prepared as she doesn't seem like she is going to let you win this one easily.

    she will claim the flat was left in an appalling state, filthy, dirty,and how she is such a good landlady that she is only claiming half of what she really could .... or some such lies !

    EL - for sure she will try to make you angry and she will tell lies about you - be prepared

    When i was in mediation, and as the mediator was in the other room with the other party, i felt myself getting more and more angry. I saw a "motto" on the wall, and started copying it out over and over and over, writing it down, just something to do to keep calm - and it worked.

    This may not work for you, but, have a strategy already thought out in advance, and practise using it ahead of time.

    Thanks everyone, I think we can use most of the index sheet that we had prepared for the last court appearance against her.

    Really all I will add is the handwritten inventory and an e-mail she sent with the breakdown of deductions as it says 'thanks for your letter' or something like that, this proving she got letter #2 which stated our intent to go to court if we did not receive a breakdown. The reason for including it being that it shows that she definately, definately knew we were angry at the delay and threatening court action, even though she is now pretending she knew nothing about it all.

    DancingFairy - seems like our court case and exam deadlines go hand in hand eh!

    Any other ideas folks?
